SO IT'S HOPELESS? No, not at all.
COMMENTARY:
Scientology's greatest strength is its greatest weakness. Separation of Church & State, leaving any religion alone--in a regulatory-free epic sanctuary.
But the religious protection is also its greatest weakness. Because it is "RELIGIOUS" protection. Hang on, i know what you are thinking. However, none of this requires that anyone prove that Scientology is not a religion. That is quicksand where there are only air bubbles where once people tried.
So, let Scientology be religion! I venture to say that it is virtually impossible to disqualify its religious status after it has been given a 70 year head start to create literally thousands of layers of protective landmines. No problem.
But there are parts of Scientology that, by precedent and tax code, are not provided with religious protections, particularly in some of its commercial enterprises and/or transactions. Those have already been excluded without Scientology's objection. Of course they didn't object because they got the other 99.99% of the bargain---the protection of parishioner donations for auditing/training services and to the IAS, Ideal Org program, WTH Foundation, et al.
OKAY MR. SMARTY-PANTS, SO WHAT? Okay this is my theory on how to handle the countless IEDs that the cult of Scientology has buried in every conceivable direction. Here is a plausible and I think viable theory that can be developed by a crack legal team to tiptoe through that minefield without being blown up by the "religious" folks over there "worshipping" their messianic Trinity (Meitreya, Miscavige & Money).
It's all wrapped up inside a misunderstood word. A word that Scientology word clearers did everything in their power to not allow the IRS to clear. The word is "DONATION".
It's legally quite simple to make a distinction between a DONATION and a PRICE LIST where one is making quite obviously making a purchase. The cult has purposely muddied the issue, gamed the issue, lied about the issue and otherwise avoided the issue. But the observable fact is that part of the religion of Scientology has a CASH REGISTER and a PRICE LIST and people are BUYING things there.
One of the cult's more favored smokescreens is the alteration of the term "DONATION" and conflating it with "FIXED DONATION".
Scientology is a self-help organization with a religious component. They need to be separated. The org can dedicate X square feet to commercial activity (i.e. pricelist purchases) and the remaining portion of the org can be a church. No conflict.
If someone makes a PURCHASE based on a pricelist, well that's a PURCHASE. If they want to tithe 10% of what they earn to the "CHURCH" component, so be it. Let the donor take a tax writeoff. But that donor cannot have less rights to worship the religion than the donor who writes a check for $600,000 to buy their "Bridge".
Get it? Anyone can worship and practice the religion for free or for a fixed tithe. BUT everyone who tithes is the same as everyone else, no matter who pays what.
This is the achilles heel of Scientology. They have thus far confused the inept and likely corrupt IRS.
I would assume that experts like Mike Rinder would know quite a bit about how to disassemble this explosive device by knowing which color wires to cut first.
There is just no way Scientology can make a reasonable defense that they are not SELLING things inside their religion. No other religion in the history of the world had a price-list.
This is what Scientology fears the most.
The only other thing that terrorizes the leader of Scientology more is that they personally will be sued and forced to appear inside a courtroom where full discovery and cross-examination and forensic accounting are legal. Inside the "religion" of Scientology, all of those things are "HIGH CRIMES" and "SUPPRESSIVE ACTS".
And that's how the "most ethical people in the world" roll !
