We have finally reached the end of briefing in the appeal that has slowed down Leah Remini’s 2023 “Fair Game” lawsuit against the Church of Scientology.

Leah is suing over Scientology’s furious and ongoing online attacks on her reputation and character, and in-real-life harassment of her family and friends, all of which has impacted her ability to make a living, she says.

Scientology for its part says that Leah started the fight with her A&E TV series, Scientology and the Aftermath, which ran from 2016 to 2019, and they say the harsh things they say about her are opinion and protected by the First Amendment.

When Scientology tried to gut the lawsuit with an anti-SLAPP motion, Judge Randolph Hammock did remove some of Leah’s defamation claims, saying they were either based on opinion or they were too old to qualify. But he kept in seven of her eight causes of action, including the allegations of intimidation and harassment.

Neither side was happy with the ruling. Scientology removed Judge Hammock and appealed, and Leah cross-appealed.

For the last year, the two sides have been trading jabs in appellate filings, which are more numerous because both sides are appealing. But now, Leah has put in the final entry, her cross-appellant reply brief, and we have the entire thing for you. It’s written by her attorneys, Daniel Saunders and Amit Vora, and we have to say it’s one of the better appeal briefs we’ve read (and there have been quite a few in Scientology litigation lately).

Saunders and Vora tear apart Scientology’s justifications for the awful things it says about Leah, and we are really looking forward to see how these two sides perform in a hearing, which will now be scheduled before too long.
