Yesterday afternoon we posted the appeal brief that Scientology submitted in Leah Remini’s lawsuit.

Scientology is asking a California appeals court to overturn a preliminary ruling that had removed some of the allegations in Leah’s case, but had largely kept her case intact. Both sides were unhappy with that ruling by Judge Randolph Hammock (who is no longer handling the matter), and Leah’s lawyers will submit their own appeal brief later.

For now, we have Scientology’s arguments for why its attempt to essentially gut this lawsuit should succeed, and in typical fashion it’s an angry, vicious attack on Leah and the work she’s done to expose the church’s controversies and abuses.

As we indicated in our brief introduction yesterday, we found the document repulsive. But could it be effective as a legal instrument? For some help on that, we turned once again to a longtime member of our community here at the Bunker, an appellate attorney who goes by the handle TX Lawyer and who not only specializes in this kind of thing, but has a good familiarity with the litigation we’ve covered over the years.

I know this well, judges don't care much for emotional/hysterical language, its offensive as it is a transparent attempt to manipulate the court. And because it is Davey's stock in trade and he takes no prisoners in disingenuously enforcing his psychotically driven attitude on lawyers as he does with everyone, he puts his attorneys in an embarrassing compromised position of shouting from the rooftops in a venue that is not at all impressed with tantrum as argument. Sometimes judges have seemed to be intimidated by the C of S, as with the ridiculous rulings binding an ex-Scientologist to Scientology-controlled "arbitration" despite the basis of the situation being that the litigant no longer subscribes to Scientology's ways. But otherwise than that, if the court has any integrity, than Scientology's bed-wetting approach to legal discourse should work against them.

That feels very true. Then again, I've seen CoS lawyers try to pull some really histrionic antics that had Davey's fingerprints all over them, proceed to have the judge slap them down... and then still go on to win the case in the end.

I do not want to be a doomsday prophet here, but in my experience external lawyers tend to be the most effective and ruthless tools the cult has. Itis not OSA, not the CMO, not PIs... its the damn lawyers.

I think it is the lawyers that are much behind most of the woes of the western world nowadays.

They are wage slaves like the rest of us and are tasked with bringing in money from anywhere they can.

The best sources, obviously, is to represent victims and get awarded costs, fees and profits. If no victims are to be found, well they work out ways to create victims through victimology thinking. Everyone is a victim, let us take you to court and get money for you. Of course, we'll take the lion's share, but we'll give you $5 for your troubles.

In many ways, we then end up becoming the victims of lawyers and their schemes and we are seeing the end results in how we are all running scared to breathe in case it become a lawsuit against us.
