The Danny Masterson Trial thread

"Bijou Phillips Takes Herself on a ‘Most Needed Vacation Ever’ After Danny Masterson’s Legal Drama"

"The only reason she’s filing to end the marriage is to put a sizable amount of Danny’s assets out of reach of further litigation.”

With Danny now being a liability, it is time to "dispose of him, quietly and without sorrow"

Here's a guarantee. . .

In the future, there is one paparazzi or tv interview question she will never, ever, ever, ever, ever answer.

"So, Bijou, during the trial you 100% supported Danny and
professed his innocence and did everything in your power
to help him go free and avoid any prison. But now you are
taking half his money & real estate and disconnecting.
So are you finally admitting that he brutally raped
those women and that you tried to obstruct justice?"

Is there any doubt that had juries not convicted him, she would have been celebrating, boozing, dancing and laughing all night in the clubs with her "innocent" beloved Danny Masterson?

I beg to differ - she is not "taking half his money & real estate" In california she is entitled to half of their combined estate - she is protecting her half from those who lust after it, such as his lawyers, women he abused, IAS regs...

Going through a divorce in California can be a complex and stressful process. One of the key aspects of California divorce law is the 50/50 law. This law is also known as community property law and means that assets and debts that were acquired during the marriage are considered equally owned by both spouses.

Good intro lecture. But I am aware of that.

What is on the table is what is COLLECTIBLE by a judgment creditor. It's not as simplistic as you indicate. There can be trusts, prenuptual agreements, third-party pledges of assets as collateral to promissory obligations, homestead exemptions, et al......

Trust me, if you ever are forced to sue someone and ultimately (after spending a fortune) win a multimillion dollar judgment vs. them and try to collect it, you'll learn more. LOL (ps: I won, but it took a full two decades of arcane legal wranglings and conquering a slippery con man's massive array of asset-hiding obstructions, multiple bankruptcies, multiple other judgment creditors making claims of priority, fraudulent conveyances, etc).

pps: I still do not have even the slightest thought that I am an expert or even proficient on this area of law. Even my world-class team of litigators regularly had to bring in outside specialists to navigate terra incognita in various legal terrains. My lead atty even admitted (after the end of all litigation) they they had never before experienced such a wildly convoluted and diabolically challenging number of obstructions that lasted for decades!)

Danny Masterson moved from LA jail to state prison in Kern County today

By now you’ve probably seen the mugshot, first posted by TMZ, which indicates that Danny Masterson was moved this morning from Men’s Central Jail in downtown Los Angeles to North Kern State Prison.

According to a California prison spokeswoman, he’ll be held there temporarily, at the prison facility in Delano, a couple of hours north of Los Angeles, as the state prison system decides what to do with him.

Masterson was convicted on May 31 of two counts of forcible rape, and sentenced on September 7 to 30 years to life in prison.

He’s appealing his conviction, and we expect that his attorneys will soon be filing a brief that describes their arguments for the appeal

My only bone to pick was that you said it was his half. In concept, they each own half, she is not after his half, but is protecting her half. Presumably she shares half their liabilities as well. I agree it gets much more complicated - for instance, is she entitled to half of his residuals? I can't blame her for attempting an end run around future collection efforts, judgements, liens, etc. to do otherwise is a form of suicide, both for herself and their child. Were I Danny, I would find no fault in her actions.

Thanks

Mimsey

since we are "bone picking" let me point out that you assume in concept "they each own half".

very hazardous business you're in. . .

I dunno if it is my assuming or my interpretation of the law in California. I think the 50/50 split is the leaping off point as they divvy up their assets. What we also don't know is if there are prenups. I wholeheartedly agree it's a complicated mess, when you have Danny's current and future legal troubles to contend with.

In a way if they both have prenups protecting their residual income streams it makes things a lot simpler, but there is still the vineyard generating income, allegedly to provide his wife and daughter a stable income. (see below) If he loses the civil suits they may go after the farm.

Reading the below it seems he has had a strategy in place since 2017.

California is one of only nine US states that enforces a community property law for divorce. While, at first glance, this law may appear to seek the fairest possible division of marital assets in a divorce, many find it rigid and even unfair in light of some unique circumstances in their divorces. Many people assume that property division is always 50/50 in a California divorce due to the community property law, but this isn’t necessarily true. While it is true that divorcing spouses must evenly divide their marital property in divorce, some property is exempt from division. It is also possible for divorcing spouses to resolve property division in several ways.

Ultimately, any divorce in California is likely to raise complex financial questions that divorcing spouses cannot resolve on their own. When it comes to the state’s community property law, many divorcing spouses enter their dissolution proceedings with misconceptions about what qualifies for division in divorce and what does not. One of the best things you can do to prepare for divorce proceedings, no matter what your case entails, is to speak with an experienced divorce attorney as soon as possible.

Danny Masterson Lists ‘Farm’ as Primary Source of ‘Stable’ Income From ‘Grapes and Wine’ – Acting Residuals 2nd
The details are revealed in a pre-sentencing document prepared by the convicted rapist’s probation officer

Masterson’s longtime wife, the actress Bijou Phillips, wrote in her plea with the sentencing judge that after her husband was first accused in 2017, he worked furiously to plant “6,000 vines” and learn the wine business, presumably so his family would be taken care of in any eventuality. Phillips filed for divorce from Masterson after he was sentenced, but that was largely viewed as a move to protect their shared assets.
Assets listed included the ranch, which Phillips said is in the Santa Ynez Valley (were the movie “Sideways” takes place); the farm, investments and three vehicles. Listed liabilities include “lawyer bills, mortgage, credit cards.”

Tony's latest post is a doozy

Actress Tricia Vessey and civil RICO added to Scientology lawsuit in proposed new complaint
Chrissie Carnell Bixler, Cedric Bixler-Zavala, Jane Doe #1, Bobette Riales, Jane Doe #2, and Tricia Vessey hereby allege against The Church of Scientology International, Religious Technology Center, and Church of Scientology Celebrity Centre International (collectively, the “Corporate Defendants”); and David Miscavige, Daniel Masterson, and DOES 1–25 (collectively, the “Individual Defendants”) as follows:

INTRODUCTION

1. The Defendants are members of a criminal enterprise within Scientology. That criminal enterprise includes many individuals, including the Individual Defendants, and a number of corporate entities, including the Corporate Defendants.

2. Defendant David Miscavige is the undisputed and unquestioned leader of this criminal enterprise and derives significant financial benefit from Scientology’s criminal and unlawful activity.

3. Scientology was devised by L. Ron Hubbard, a science-fiction author who was dissatisfied with the income that vocation provided him. As his wife explained, Hubbard believed that “‘[t]he only way to make any real money was to have religion.’ That’s essentially what he [Hubbard] was trying to do . . . Get a religion where he could have an income and the government wouldn’t take it away from him in the form of taxes.” A science-fiction associate of Hubbard’s similarly recounted that Hubbard believed “the only way to make a million dollars was to form your own religion.”

4. Scientology’s self-described governing philosophy is “MAKE MONEY. MAKE MORE MONEY. MAKE OTHER PEOPLE PRODUCE SO AS TO MAKE MORE MONEY.”

5. Many of Scientology’s criminal enterprise’s money-making schemes are criminal in nature; it routinely and systematically engages in fraud, human trafficking, identify theft, and money laundering to fill its coffers and enrich its leadership.

6. Scientology’s criminal enterprise also makes money by selling pseudo-scientific “auditing sessions.” Scientology’s criminal enterprise claims these sessions “bring people from a condition of spiritual blindness to spiritual existence” and that they cure arthritis, dermatitis, asthma, coronary difficulties, eye trouble, bursitis, ulcers, sinusitis, cancer, and any number of other physical ailments. As befits such lofty (purported) results, customers who purchase the entire course of auditing sessions spend upwards of $500,000.

7. As with many criminal enterprises, Scientology’s takes steps to protect itself and its co-conspirators from governmental authorities. Scientology’s criminal enterprise takes a two-faced approach to protecting its criminal activities: it simultaneously presents an innocuous front to the public while terrorizing any who speak out about its unlawful activity in order to intimidate them and dissuade them from seeking protection from law enforcement or from cooperating with governmental authorities.

Yeah, I couldn't put my finger on it, but that's the image I had in the back of my head. As I said, scary. Creature-like.

I think, long range, he's going for a ZZ Top look. By the time he gets out he should have a nice Kris Kringle thing going.

I just noticed that Masterson and Hubbard were both born on March 13th.

That must be special to have one's birthday on such a special Scientology holiday. :coolwink:
Weird, I noticed that like me, he's 5-10 160. And my bday one day different, 3-14, but I'm much older. That's ok, I'm relatively confident we'll never be mistaken for each other :)
