Danny Masterson’s habeas petition attorney Eric Multhaup on Friday submitted a motion to the appeals court asking to amend the petition based on what he said was new evidence of a “Brady violation.”
That refers to a prosecutor holding back information that might sway a jury of a defendant’s innocence.
In this case, Multhaup argues, it’s based on something that came up in an unrelated lawsuit filed by one of Danny Masterson’s victims, who is referred to as Jane Doe 1 in the criminal case that put Masterson behind bars for 30 years to life.
In a separate, unrelated lawsuit, Jane Doe 1 is suing the Church of Scientology, its leader David Miscavige, and her ex-husband, Scientology Sea Org recruiter Gavin Potter. She alleges that Scientology forced her to marry Potter at 17 after he sexually assaulted her, in 1990.
Because of some complicated unrelated matters that we’ve written about before, Scientology convinced Judge Kevin Brazile that Jane Doe 1 should have to sit for a special deposition, which she went through more than a year ago.
During that deposition process, Jane Doe 1’s attorneys asked for the court to allow her assistance to accommodate a disability, saying that a live transcription of the questions would help her formulate answers.
A court transcript suggests that Judge Brazile ultimately did not approve of that request, and the deposition proceeded without that extra help.
But Multhaup, in the Masterson habeas case, is saying that when Jane Doe 1’s attorneys asked for that transcribing assistance, they revealed that she had also asked for that help when she was scheduled to testify in Danny Masterson’s criminal trials (which took place in 2022 and 2023), but prosecutor Reinhold Mueller convinced her not to make that request of the court. (According to Multhaup, Mueller told Jane Doe 1 that the jury might be distracted by the use of live transcriptions and view her testimony skeptically.)
