Danny Masterson is not going anywhere. His appeal asking for his conviction to be thrown out or for a new trial was flatly denied today by California’s Second Appellate District.

Masterson was convicted of two counts of forcible rape in May 2023, and he was sentenced to 30 years to life in state prison. He appealed with one of the best appellate attorneys in the country, Cliff Gardner, who attacked several different areas of Masterson’s prosecution, including how the prosecution brought the case under California’s “One Strike Law,” how much testimony about Scientology Judge Charlaine Olmedo allowed, and the credibility of the Jane Doe witnesses.

The Church of Scientology, meanwhile, submitted a “friend of the court” amicus brief saying that Masterson’s conviction should be thrown out because the court was hostile to his religious rights.

None of it won over the appeals court, which not only affirmed the jury’s verdict, but also denied Masterson’s habeas petition.

We have just obtained the 89-page ruling. We will be adding it to this post as quickly as we can, so check back soon to see what the justices had to say about Gardner’s arguments and especially about Scientology in the courtroom.

Back soon…

That just breaks my heart. Couldn't happen to a nicer malignant narcissist.

I get it but I don't get it...

Why is Scientology spending bigggg bucks on these long-shot appeals. What kind of diabolical deal must Masterson and the cult have made to protect each other?

I haven't seen the invoices but the cult must have spend several million dollars for his defense—even before he was pronounced guilty. And now the cult is spending millions more.

M I L L I O N S ! ! !

Jeez, I wonder how the IAS registrars hoaxed their delusionally duped donors to contribute millions for the noble cause of: "A WORLD WITHOUT CRIMINALITY"—whilst using their millions to instead create "A WORLD WITH SERIAL RAPISTS"?

FUN FACT: The reason why the cult hoax named Scientology and the serial rapist named Danny Masterson have joined forces is because they are both stark raving MAD. Not mad in the sense of angry. MAD in the sense of a MAD pact. Mutually Assured Destruction pact. When two nations (or companies or individuals) both possess enough nuclear weapons to destroy each other 10 times over, they are then doomed to cooperate and do everything possible to avoid war. That's why Minister Miscavige and Molester Masterson are best friends forever. Either one could devastate the other with a single
25 minute press conference or videotaped message exposing the other's complicity to COVER UP, SUPPORT and even PERPETUATE a serial rape crime wave. That's the same amount of time required to for the USA and Russia to launch and explode devastating nuclear weapons on each other.

Masterson could devastate the CoS as he's an eyewitness to the CoS covering up a serial rape-crime wave.

I doubt the CoS could do anything to devastate Masterson. He's already serving life in prison for the crimes he was convicted of. If CoS came forward with information about additional crimes, it would be risky for them to do so because they were the ones who conspired with Masterson to cover them up.

IMO, Masterson holds all the cards, and that's why Miscavige is so willing to do whatever it takes in an attempt to help Masterson.

Usually, if a Scientologist causes a PR flag of this magnitude, Miscavige will throw him under the bus so fast. But in this case, they're likely spending millions in an attempt to help him.

It will be interesting to see going forward if CoS continues to help Masterson. In today's blog post at the Underground Bunker, TX Lawyer goes over Masterson's remaining legal options. He concluded:
In all probability, this is the end of the legal road for Danny Masterson. Sure, he can petition the California Supreme Court to review the case and, after appeal is over, he can petition the U.S. Supreme Court for review by certiorari. But those are both courts of discretionary review. They get to pick and choose which cases they take up on the merits. And just as a cold, hard fact of math, they both take up something like 80 to 100 cases annually, out of many, many thousands of cases that seek such review. Danny’s appeal does not present any clearly important legal issues that those courts need to straighten out, and it’s hard to figure why either court would want to go out of its way to review the case of a defendant who was convicted on ample evidence of the same type that puts any number of rapists behind bars every year. And habeas corpus? That was so weak that this court denied it without comment.

Agreed, with one minor tweak. . .

Miscavige could actually further devastate Masterson for this reason. Masterson's only hope is......hope. As distant as that may be it's still hope. Maybe a miracle. Maybe something turns up that derails his conviction that was hidden or incorrectly managed during the discovery or trial. Maybe a juror pipes up claiming "tampering". Maybe there is an unconstitutional glitch in the prosecution where they failed to disclose certain exculpable evidence. Maybe he gets a presidential pardon. Maybe the radical left fully conquers all the California judiciary and executive key positions and they 'defund prisons" and shut them down. Maybe there is a new covid and the prisons are emptied for that reason. Ya never know. So as long as Masterson has some remote dim hope, it's still something to live and strive for.

However, if Miscavige decides he wants to nuke any further "hope" all he has to do is claim "hacking" or "espionage" and then thru channels REVEAL THE CONTENTS OF MASTERSON'S SEC CHECKS AND O/W WRITEUPS AND ETHICS CYCLES. Those contain proof positive and confessions that would eliminate all hope and any chance at the end of his decades-long sentence of being paroled.

All speculative of course, but I verified all the above information with a fully charged e-meter so that would be scientific proof, right? LOL!

Yeah, good point.

Also, the California Supreme Court Justices could decide to review the case in an effort to increase the life expectancy of their pets.

Sec check notes are hearsay. O/W write ups are much more damaging, because they are confessions in the person’s own handwriting.
