Danny Masterson is not going anywhere. His appeal asking for his conviction to be thrown out or for a new trial was flatly denied today by California’s Second Appellate District.

Masterson was convicted of two counts of forcible rape in May 2023, and he was sentenced to 30 years to life in state prison. He appealed with one of the best appellate attorneys in the country, Cliff Gardner, who attacked several different areas of Masterson’s prosecution, including how the prosecution brought the case under California’s “One Strike Law,” how much testimony about Scientology Judge Charlaine Olmedo allowed, and the credibility of the Jane Doe witnesses.

The Church of Scientology, meanwhile, submitted a “friend of the court” amicus brief saying that Masterson’s conviction should be thrown out because the court was hostile to his religious rights.

None of it won over the appeals court, which not only affirmed the jury’s verdict, but also denied Masterson’s habeas petition.

We have just obtained the 89-page ruling. We will be adding it to this post as quickly as we can, so check back soon to see what the justices had to say about Gardner’s arguments and especially about Scientology in the courtroom.
