Our expert, TX Lawyer, told us that Danny Masterson’s request to combine the two ways he’s appealing his criminal conviction — with a direct appeal and a habeas corpus petition — seemed unusual. And now, the 2nd Appellate District has apparently agreed, putting out notice on the docket this weekend that this request was denied.

Masterson, the Scientology celebrity and That ‘70s Show actor, was convicted of two counts of forcible rape on May 31, 2023 and was sentenced to 30 years to life in prison. He’s currently at the Men’s Colony in San Luis Obispo County. His direct appeal, handled by well-known post-conviction attorney Cliff Gardner, was fully briefed through 2025, and is now awaiting the scheduling of an oral arguments hearing.

But in the meantime, Masterson also filed a habeas petition on December 1. As TX Lawyer explained to us, the difference is that the direct appeal questions what happened during Masterson’s trial, but the habeas petition brings up supposed evidence that was not introduced at trial.

They are two separate approaches, and that’s why it seemed unusual that Masterson would ask to consolidate them, especially since the direct appeal is so far along and would get slowed down to the habeas petition’s schedule, which could go on for several more years.

But the court is not interested in handling them as one case.

I do wonder if Masterson's legal defense is being funded by the cult, and how it would play out if the "whales" who contribute mega donations were to be informed that their money was being used to try to get a serial rapist off the hook. And whether the cult's strategy with them would then be to deny any supportive connection (such a denial being not difficult to refute) or to claim that the accusers are all "SP's trying to destroy Scientology so that they can enslave mankind". Either way it would be fun to watch. :)

Not exactly good pr!

Investigation on the true motives behind his support to Masterson would certainly reveal an interesting unknown story!

Scientology is already closely tied to Masterson, including trying to silence his victims and supplying briefs to the court in support of the defense. The strategy has been to try to orchestrate findings of innocence, and failing that, having the guilty verdicts overturned, thus enabling the cult to "dead agent" the "black PR". One thing Miscavige is blind to is when to cut his losses and reverse course, and he's too given to hysterics to let criticisms pass and instead draws more attention to them with all the cult's ham-fisted counter-accusations and denials. I think that sooner or later he'll wake a sleeping lion who won't back off and will instead escalate things and that could be the death of him, figuratively or otherwise.

It's amazing how he has no clue that public opinion is very harsh to serial violent sexual agressors and to those who comme toi their defense..

No one would want to be associated with this convicted criminal unless Davey.

In the "wog" world, apart their family, ni people would stand up to protect a serial sexual agressors , unless closely involved and thus, wanting the case to be dropped...

Cult attitudes supersede objective recognition of right and wrong, bad and horrific. Like with the Epstein files.
