Danny Masterson was sentenced to 30 years to life in prison in September 2023, and since then his attorneys have been working on trying to overturn that conviction.
In January, they submitted his “opening appeal brief” to California’s 2nd Appellate District, and our expert TX Lawyer found it professional and well-written, but criticized its focus on the accounts of the Jane Doe victims.
In August, the California Attorney General’s office answered with a “respondent’s brief,” which TX Lawyer thought was a pretty overwhelming comeback to Danny’s appeal.
Now, Masterson completes the briefing with his “appellant’s reply brief,” which answers the arguments of the state AG. We have the entire thing for you below.
And it showed up just about the same time that Masterson’s lawyers also filed a habeas petition, arguing that Masterson received ineffective counsel during his trial, and they also attacked the amount of focus on Scientology, of which Masterson is a celebrity member.
Some of the findings of the habeas petition are mentioned in today’s brief, and tomorrow TX Lawyer will help us understand the difference between the two approaches — the direct appeal and the habeas petition — and the signs suggesting that they are both being influenced by Scientology itself.
