The Danny Masterson Trial thread

Oh my.

I looked at the length of the video and thought "I'll just watch the first 10 minutes to see if anything interesting is said". And I got sucked in.

Danny is in deep, deep shit. Give him a few weeks in there and he will be ready to throw all of Scientology under the bus. Which means that Miscavige may be looking into having Danny whacked before that happens.

It was live....and I didn't catch the beginning....so will go back and watch again.

I really had no idea. Sure prison movies...show the gangs...and some rough stuff...but nothing like he describes.

Really is a Code of Conduct that the prisoners enforce upon them selves....and all must follow. But wow....what a code of conduct!!

Plus...a completely new language too... I knew nothing about that.

"Car" was an example.... Meaning one's group....segragated totally by color....

Sexual offenders are so far at the bottom.....that they don't even have a place at the bottom. They are off the bottom of the chart....and special rules apply to them....

I watched the first 14 mins of the video so far and it was pretty shocking.

Masterson will run the Criminon program in there though, getting them all through conditions. So, he'll be ok.

..
It is common, usual and sensible for a defense attorney not to have his client testify. They are usually far more likely to damage their case than to bolster it. And what testimony could anyone offer that would persuade a jury that Masterson didn't or couldn't have committed the rapes? "He's a good guy", etc, is weak and laughable. And lying to provide an alibi invites perjury penalties.

.
Good point.

However there is much more compelling fact-driven, scientifically supported testimony that a defense witness can provide. Such as:

"I was Danny Masterson's auditor for the past 39 years and I
can testify here today, under oath, that whenever I
asked him if he raped anyone it always F/Ned."

If one of those low-tone prosecutors tried to impeach that testimony, the auditor could simply enter into evidence a graphic exhibit proving that Danny's OCA score is all above the center line.

You make an important point. Masterson will feel total desperation which would make him extremely likely to do ANYTHING to stop the terror; including throwing Scn under the bus.

The problem is that in doing so:

-- He might inadvertently sabotage his own civil lawsuit

-- He might weaken or ruin his chances for a successful appeal

-- There is no guarantee that by him blowing the whistle on the COS it would reduce
his criminal sentence.

Normally in the fashioning of a sentence reduction, the rat is given NO GUARANTEE that their cooperation will produce less years in the penitentiary. The judge can consider it as a mitigating factor but I don't believe that they have any obligation to do so. This is (I believe) not the case where a plea deal is worked out and that package is presented in court. Masterson did not enter a plea deal and thus he is still hoping to overturn his conviction on appeal.

Even if the judge rewarded his testimony throwing the cult under the proverbial bus, it wouldn't change the outcome of his criminal trial---because Scientology was not a party to that action. Scientology is a party in the civil lawsuit, so why would Judge Olmeda have any reason to reduce a criminal sentence that only might affect an unrelated civil trial?

We need lawyers to weigh in on legal strategies and precedent-setting case law.

At this point, Masterson's only exit strategies are:
  • Overturning the verdict on appeal
  • Gambling on serving his time before being murdered.
  • Prison break and travel to non-extradition treaty nation
  • Suicide
Naturally, he would not want anyone to think he killed himself. Thus, he would need to leave a written r-factor of how he had left the body on his own self-determination, in order to journey to deep space and conduct advanced research on the OT levels with Ron.

There is another bizarre concept that might help Masterson. What if the NOI has sufficient presence in California prisons and Masterson can have his people negotiate a deal on the outside with Abdul Malik Sayyid Muhammad; otherwise known as the Freedom Medal winner Tony Muhammad. If NOI has its own gang inside the prisons (or if NOI can broker a deal with the actual Muslims) Masterson might be able to make monthly protection payments to Tony who will do whatever it takes to keep his cash cow alive. Probably Tony would have to "kick up" a percentage to Farrakhan.

Hey, who knows, maybe Danny becomes a member of NOI's elite "Fruit of Islam" and changes his name to Muhammad 5.4X.

Or, as an "ethics officer" once actually did with me to "prove" that she was right and I was wrong, he could simply point to his clear cert.

LOL!

I guess that is just like one of those moments in scientology where one thing trumps and "rises above" another, like the moment--

-- that Ron is criminal & critical but he doesn't need to do lower conditions and sec checks,
to handle his case because he already "rose above" the bank.

-- that senior cult leaders don't need to follow policy because on the admin scale "Purpose is
senior to Policy".

-- that the only way you can stop a cult executive from handling/correcting you is to point to
your Clear or OT certificate (or your photo on the cover of Celebrity magazine) because
on the cult's command channel "status outranks logic".

I see another I'm surprised not to have already been mentioned. He could simply declare himself to be a trans woman. Daniella could then demand to be sent to a women's prison. It's a win/win for her and a middle finger to everyone else.

Dang!!! LOL!!

That would definitely be making it go right!

Very creative! The only downside is that an all-woman prison might hate him even more than a men's prison— because of his history of serially raping women.

However, it might work if he goes to a women's prison as long as he makes it go right to NOT FALL ASLEEP for the next 30-50 years.

Those women would be transphobic. And he would still have the same body that formerly belonged to a man. So I still think he'd have a better chance there.

Danny Masterson entirely lacks the capability to "throw all of Scientology under the bus". He was a public member who was never even a staff member, let alone a Sea Org member. He knows jack shit except for his so-called Ethics Handlings and maybe his confessional auditing.

So far as I am currently aware, nobody in law enforcement has said one word about going after any C of $ staff members for Misprision of a Felony or any other criminal charges relating to the cover-up efforts which (to the best of my knowledge) the civil case deals with.

I would be good money that Masterson does have the capability to throw Scientology under the bus. If Scientology obstructed justice in any of the cases involving Masterson or engaged in criminal activity when following its Fair Game scriptures, and Masterson is aware of any of this, that could be very bad for Scientology if CoS did anything to piss Masterson off. There is a grand jury proceeding that I believe would be very interested in what Masterson has witnessed along these lines.

I'm sure that Miscavige is doing all he can though to ensure Masterson lacks the motivation to throw Scientology under the bus. Miscavige will spend tens of millions of dollars or whatever it takes to ensure Masterson doesn't turn against the CoS.

Yes, I kinda understand that.

My understanding was that his Defense Lawyer didn’t call a single witness. Not one. This seemed odd to me. But I could be wrong..
Who could they call?
A) they cross examined each to the witnesses to try and poke holes in their testimony.
B) let's say they called Claire's father in law to portray her as an apostate. What testimony could he bring forth that wouldn't highlight the Scientology problem, which Cohen was trying to play down?
C) what could Danny say on his behalf - they consented? For example, the Jane Doe he drugged and raped in Canada. She was married, was there with her daughter and husband. At what point could he feasibly say he had her permission? She had no idea who he was until seeing him in the movie - it wasn't as if she fell for his star power and boinked him.

Lee, let's assume you were the lead council in Danny's defence - who would you call? The CC President's son? Would he lie for Danny and say Yep, he asked her, I heard her say Hey Danny, let's knock it out? Would he come across as believable? Who else could you call? Jason Schwartz? IJC? Would they stand up under cross examination?

Cohen had an unenviable task - to fight over table scraps, when the main meal was cooked and ready. He and Holly did the best they could. They didn't have a ringer in the jury as in the first trial. The judge made sure of that.

The next big question - will they retry the hung decision on the remaining Jane Doe?

If I were her and I had any say in the matter, since he's slammer bound, I'd pass. I'd want to move on with my life.

I'd like to know who you'd call if you were calling the shots.

This business with Vicki Pop. going over the prosecution to the chief was not for nothing - it was COB's calvery riding in to help Danny (and save Scientology's image).
Why would he try and help Danny? This bypass of a junior is almost exactly what COB did with the IRS. Maybe he's stuck in a win? Has an inflated sense of his position in wog society?

yes, and he has certainly got to have at least some knowledge of the details of what was done in his case, plus who was involved in doing it going up to at least the CC president's office.

and i bet there is a fair chance he knows about others who were either part of his drugging and raping of women -- including where the drugs came from, and who else bought them -- and even other crimes as well.

in ASL's video a few days ago, it sounded like a bar he was involved with was date rape central -- where drugs came from, and where perps congregated and would have known about each other and who the victims were.

i don't see him flipping both because of his family connections, and that it would involve admitting that what he did was wrong -- i suspect his psychopathic worldview is that it wasn't, and regardless he seems completely invested in defending what he did one way or the other. if he'd realized that what he was doing was wrong after the first victim reported it to the CoS, and really made amends with whoever the victims had been, things wouldn't have ended up where they did....

I tend to think, when he settled for the $400k, he had been read the riot act by the MAA and told to make amends. Everybody thought the flap was handled. It was, for all practical purposes, until the Jane Does found out they weren't the only ones. When they found out he wasn't getting ethics handling - it all came apart at the seams.

It begs the question, why didn't he pay each of them off? Nip it in the bud?

I never said he could. But he would be WILLING to.

And do not assume that his celebrity status and mingling with high level SO has not gotten him a degree of knowledge on how things really work.
