[Danny Masterson and his current address]
Yesterday we found out that the California Second Appellate District denied Danny Masterson’s criminal appeal and habeas corpus petition, affirming the convictions that have him serving 30 years to life in state prison. We posted the entire ruling, which includes the court’s finding that Masterson’s religious rights were not infringed by testimony about Scientology in his trial. We asked our appellate attorney expert TX Lawyer to look over the opinion and give us his assessment of it, and of Danny’s future options.

In all probability, this is the end of the legal road for Danny Masterson. Sure, he can petition the California Supreme Court to review the case and, after appeal is over, he can petition the U.S. Supreme Court for review by certiorari. But those are both courts of discretionary review. They get to pick and choose which cases they take up on the merits. And just as a cold, hard fact of math, they both take up something like 80 to 100 cases annually, out of many, many thousands of cases that seek such review. Danny’s appeal does not present any clearly important legal issues that those courts need to straighten out, and it’s hard to figure why either court would want to go out of its way to review the case of a defendant who was convicted on ample evidence of the same type that puts any number of rapists behind bars every year. And habeas corpus? That was so weak that this court denied it without comment. Never bet on habeas succeeding.
