On May 31, 2023, we were in the courtroom and heard the guilty verdicts and watched as Danny Masterson was cuffed and taken into custody.
Now, more than three years later, Masterson gets his day in court as his appellate attorney Cliff Gardner will appear before the Second Appellate District, Division Two, at a hearing room in Los Angeles to argue that Masterson’s conviction should be overturned.
Fortunately for us, we can all tune in and watch online as Gardner and an attorney for the state attorney general, Blythe Jeanne Leszkay, make their arguments and answer questions for the panel of three justices.
The session is scheduled to begin at 12:45 pm Los Angeles time (3:45 pm New York, 8:45 pm London), and just before that the court will make the online link available. We’ll post it here and at social media as soon as it’s up.
Six cases are scheduled to be heard before Masterson, which is set for last. So it may be more like 3:45 pm before the case comes up.
Division two has four justices, and three are hearing the cases today: Victoria M. Chavez (on the division bench since 2005), Anne Richardson (2024), and Stephen Goorvitch (just confirmed last month).
Masterson, the Scientology celebrity and That ‘70s Show actor, was convicted of two counts of forcible rape under California’s “One Strike Law” and is serving 30 years to life in prison. He’s currently housed at the Men’s Colony in San Luis Obispo County. He turned 50 on March 13.
We asked our appellate attorney expert, TX Lawyer, what he’ll be watching for during today’s hearing.
