The Danny Masterson Trial thread

In a criminal trial, the defendant is presumed to be "Not Guilty" unless the Prosecution presents sufficient evidence to convince the jurors that he IS guilty beyond a reasonable doubt. The burden of proof is fully on the prosecution. The attorneys for the defense have no need to call any of their own witnesses if they can (via cross-examination) create uncertainty in the minds of the jurors about the guilt of the defendant. That IS what they did during the first trial and it succeeded in keeping Masterson out of prison due to a hung jury on all three counts.

The attorneys for the prosecution did a great job of making adjustments after the first trial, figuring out how to counter the strategy of the defense attorneys and how to relate a more coherent narrative to the jurors so they would more easily understand how everything went down. They put on a very strong case and the Jane Doe's and the other witnesses came across as credible and the jurors believed them. And from all accounts Deputy Dist. Attys. Reinhold Mueller and Ariel Anson were great during the closing arguments.

Masterson had some really good attorneys including Shawn Holley, who was one of the "Dream Team" attorneys for OJ Simpson that got him acquitted. But they didn't have much to work with.

Entirely correct, It seemed like there was a night and day difference between the first and second trials. But OSA, and David Miscavige’s role in fair gaming the Jane Does and obstructing Justice is still in the process of being unearthed. Think about this; while the Jane Does we’re going through Scientology’s “Justice” system, which involved, on the one hand, a $400,000 payment by Masterson in exchange for one of his victims signing an NDA, while gaslighting another of his victims to figure out what SHE HAD DONE TO PULL IT IN - Scientology’s only interest was in protecting itself.
David Miscavige couldn’t have given less of a shit about the fact that Masterson was drugging and raping his fellow Scientologists.

This is the utter insanity of Scientology. One rape victim receives a payout, while the other rape victim is told to wash Masterson’s fucking car.
Keeping them quiet, and keeping it out of the press was ALL that mattered.

Scientology for 20 years has known that Masterson drugs, then rapes women. What did they do? They submitted 50 affidavits to the LAPD that OSA hoped would kill any prosecution from the outset.

The Federal courts MUST TAKE NOTICE OF THIS; that when they acquiesce to the farce of permitting Scientology’s internal “arbitration” system in Civil cases, the Courts themselves are aiding and abetting a criminal organization.

How is it possible that Danny Masterson put up NO DEFENSE at either of his Trials.... ( yet he and his entire posse were sure that he would be found not guilty....?)

my understanding is that it's not uncommon in trials like this for the defendant not to testify -- particularly if they have an attitude that may get them into trouble in cross examination, could come across as unlikable to the journey, or are guilty and thus would have to try to lie effectively. and i think the prosecution would have been able to ask him about things like his DJ Donkey Punch persona.

I know "donkey punch" was not allowed in the first trial, and I think for the most part, it's not a common term. I would guess questions not directly related to his crimes wouldn't be tolerated, such as that monniker. As a professional actor, I think he could lie with ease, but being on the stand opens the door for him to be eviscerated with all manner of questions as they try to paint him into a corner.

Masterson's preternatural powers of prevarification extend well beyond that.

His pathologically professional skills at lying are derived from a multitude of 'beingnesses' and spiritual 'states', including but not limited to those of:

- - a professional actor

- - a hollywood celebrity

- - a criminal

- - a sexual predator

- - a sociopath

- - a scientologist

It's noteworthy that only the last one on the list boasts a deviancy academy that offers courses, drills & jumbo diplomas for acquiring deception skills—not to mention celebratory applause and cheers when proving one's ability to successfully lie.

Interview with Danny's former Step Father....

.

Outstanding!

That interview with Joe R. was a powerful and poignant look at the raw corruption, treacherously toxic and maniacally manipulative world of Scientology as it actually is practiced--not the pretend gaslighting version in the marketing materials or within the imaginations of delusional cult members.

Ultimately, everyone eventually slams into the brick wall of Scientology's totalitarian control machine and learns the same lesson; to wit, that you cannot win when the cult begins winding around you and your loved ones like a boa constrictor. The snake is not thinking about you, it's only thinking about the moments when you briefly relax & exhale as a cue to further tighten its chokehold.

Bravo to Joe for maintaining his sanity and reclaiming his life. Funny, isn't it, that the declared "SPs" are the only graduates of Hubbard's "Ethics & Integrity" courses/auditing that have any integrity.

Now that Danny Masterson is convicted.....will cameras ... be allowed in the Court Room....at his next appearance there? Is this at the discretion of the Judge?

As the exact date is known....Aug 4th....I would imagine that TMZ and many paperazzis will be on hand to try to get pics of Masterson in the orange jump suit....handcuffed and shackled....

Will be interesting to see what 9 weeks in Jail does to his demeanor....

I'll just leave this here......

Some interesting info at the end.....apparently his guy is selling a program on how to survive in Prison.....

Danny Masterson - “High Power Unit”

In this video, I will take you into LA Mens Central Jail. Masterson is actually staying in the same pod where other celebrity lawbreakers had once resided, such as Suge Knight and O.J. Simpson. This is called the "High Power Unit"

Masterson does not have a television in his cell, though he has access to the books that are available from the jail's library. He is allowed to leave his cell for two hours each day, at which point he can access the day room where there is a television and a telephone. He is limited to three hours of recreation a week and can shower every other day, though he'll be allowed daily showers if he's going to court. He isn't due back until Aug. 4 when he'll be facing his sentencing.

He's held at the "High Power Unit"... I guess that's their version of the Superpower Building, huh?

Truly amazing interview with a former Prison Inmate. A fantastic education in Prison lingo.....prisoner rules and regulations...made by other prisoners. Who is boss....and how things are run. WoW!

Before watching that video, I had this vague notion that Masterson could elect to be in protective custody and just remain alone or in a safe cell. However....my eyes are still bugged out listening to the horrifying living nightmare Masterson now finds himself in. I had no idea.

I don't see how he survives that hell or ends up killing himself to exit the most terrifying existence imaginable.

Ironically, he is powerless to stop it---the same way his drugged victims were.

Again, i knew going to prison would be bad but what Aaron's guest described is diabolical and inhumane torture. Same kind of terrorism that Masterson subjected others to.

How is it possible that Danny Masterson put up NO DEFENSE at either of his Trials.... ( yet he and his entire posse were sure that he would be found not guilty....?)

My understanding is that at this last Trial, at least, Phillip Cohen, Danny's Defense Lawyer did not call one witness for the Defense.... Not a single one.

My question is.....who's legal strategy was that?

Time wise....all these Rapes occurred during the time that "That 70s Show" was actively being shot / filmed and shown on TV.

So, not a single cast member was reliable enough to take the stand and say.....Danny was an OK guy????? Not one Stage Hand....Lighting guy....Makeup Artist...???

I saw a video of Aston Kucher being asked a question about the rape accusations.....and he side stepped the entire thing....very smoothly.

I can see that no Hollywood Celebrity would want to step into this mine field....due to their PR and Career. But not one?

So....here is my problem.

How ,on one hand, could he feel sure of a Not-Guilty finding....
But on the other hand could not find one person, legally safe enough to put on the Stand in his Defense....?

Seems kinda screwy to me...

For sure COS ( Cult of Scientology) had a hand in crafting his Defense.....??

It seems incredibly stupid to have a Defense of only attacking...nit picking....and bullying Prosecution Witnesses when that is what was done to them by Danny in the first place. Just more of the same treatment... (to put it mildly) But this time in front of a Jury..... How stupid!

Anyway...even though just the 2 Guilty Verdicts...and 1 Hung Jury.... I believe there are at least 7 girls....makes some claims...??
It is common, usual and sensible for a defense attorney not to have his client testify. They are usually far more likely to damage their case than to bolster it. And what testimony could anyone offer that would persuade a jury that Masterson didn't or couldn't have committed the rapes? "He's a good guy", etc, is weak and laughable. And lying to provide an alibi invites perjury penalties.

Yes, I kinda understand that.

My understanding was that his Defense Lawyer didn’t call a single witness. Not one. This seemed odd to me. But I could be wrong..

WoW!

Oh my.

I looked at the length of the video and thought "I'll just watch the first 10 minutes to see if anything interesting is said". And I got sucked in.

Danny is in deep, deep shit. Give him a few weeks in there and he will be ready to throw all of Scientology under the bus. Which means that Miscavige may be looking into having Danny whacked before that happens.

but who are they going to call? it doesn't seem like a situation where alibi witnesses would be relevant, for example.

and i think if they'd called some sort of expert witness, it could have risked seeming that they had a hired gun defending rape, which might not have gone over well with the jury.

and as with Danny himself, the prosecution's cross-examination of any testimony could have made things worse.

isn't the fundamental problem that they had a guilty client, who was a serial pattern rapist? what do you do except try to nitpick the prosecution's case?
