[Scientology’s Sarah Heller]

Now that the Save the Garden movement has had its 7,500 signatures certified by the Clearwater city clerk, its petition asking the city to rescind the gift of a downtown street to the Church of Scientology will be discussed by the city council on Nov 5.
In the meantime, Scientology has left no doubt about where it stands. Answering a local television station that inquired about the situation, Scientology’s Sarah Heller sent Tampa Bay 28 a fiery letter.
Scientology’s position, Heller explained, was that if the city acts on the petition and stops the handover of the street — where construction has already begun — it would be a violation of Florida state law.

THIS PETITION IS UNLAWFUL. A petition cannot override Florida law. The Clearwater City Council lawfully approved the Garden Avenue vacation, the ordinance has been recorded, the development has been approved, and construction is underway. Save the Garden is attempting to use a referendum to overturn those approvals despite an express statutory prohibition against referendums concerning development orders. Collecting signatures does not eliminate that legal defect.
Wow, she sounds angry.
