Re: Prohibiting Punishment of Acquitted Conduct Act of 2019

Dear Chairman Graham and Ranking Member Feinstein:

The undersigned organizations write in support of the Prohibiting Punishment of Acquitted Conduct Act of 2019, which was introduced this week by Senators Durbin and Grassley, and cosponsored by Senators Leahy, Tillis, Booker, and Lee. This bill would end the unjust practice of judges increasing sentences based on conduct for which a defendant has been acquitted by a jury.

The Fifth and Sixth Amendment guarantees of due process and the right to trial by jury for those accused of a crime are fundamental to our criminal justice system. These guarantees require the government to prove a defendant’s guilt to a jury beyond a reasonable doubt.

Despite this, current federal law allows judges to override a jury’s not guilty verdict by sentencing a defendant for the very conduct he or she was acquitted of by the jury. This is because the law requires a jury to convict beyond a reasonable doubt, but allows a judge to impose sentencing enhancements based on the less demanding standard of preponderance of the evidence.

Permitting sentencing based on acquitted conduct is unjust, undermines due process, and subverts the critical function of jury trials in our legal system. This practice has been roundly criticized by practitioners, judges, and scholars. In one case, three defendants were convicted of possessing small amounts of crack cocaine, but were acquitted by the jury on conspiracy to distribute charges. Nevertheless, the judge increased their sentences based on them engaging in a conspiracy. Though the Supreme Court did not take the case, Justice Scalia, joined by Justice Ginsburg and Justice Thomas, stated that the practice of sentencing based on acquitted conduct “has gone on long enough” and constituted a likely violation of the Sixth Amendment. Additionally, former Judiciary Committee Chairman Hatch introduced the original version of this bill in 2018, and has persuasively argued that justice depends on conviction by a jury, not a judge.

Allowing acquitted conduct to be considered in sentencing also exacerbates the trial penalty, which is generally manifested in the significant difference in sentence between what a defendant receives via plea bargain and what his or her sentence would be if convicted at trial. This trial penalty has virtually eliminated the constitutional right to a trial in the federal system. It also contributes to the possibility of innocent people pleading guilty, because they fear the long and harsh sentence they would receive if convicted at trial, even if the chance of conviction is remote. Unsurprisingly, the crucial constitutional protection that the right to trial by jury provides is weakened when a defendant may be sentenced based on conduct even when he or she is acquitted of that conduct by a jury. This contributes to coercive plea bargaining and to the trial penalty.

In a letter on Oct. 9 to Mr. Trump, scores of advocacy organizations, some participating in the International Religious Freedom Roundtable that meets on Capitol Hill in Washington, called on the president “not to abandon Christians, Yazidis and Kurds” who are the inhabitants of the Syrian border region that Turkey is bombing to create a “safe zone.”

“It was deeply shocking to us as advocates for international religious freedom,” as the region “is a rare example of success for U.S. military intervention post-911—a showcase for religious freedom and democracy,” the letter said of the president’s decision.

“It undercuts our own trust that this administration is truly committed to international religious freedom and the survival of religious minorities in the Middle East,” it said, adding that “the proposed invasion zone includes key historic Syriac Christian towns and churches, all Kurdish majority towns, the population, and key administrative and education centers.”

Yesterday, the Family Research Council (FRC) tweeted the International Religious Freedom Roundtable (IRFR) letter on Northeastern Syria that was signed by the Church of Scientology National Affairs Office. According to Wikipedia, the FRC "is an American fundamentalist Protestant activist group, with an affiliated lobbying organization. Its stated mission is "to advance faith, family and freedom in public policy and the culture from a Christian worldview"." Tony Perkins is its current president of the FRC. As previously noted, the IRFR was founded by Scientology lobbyist Greg Mitchell.

There is significant evidence of China's systematic use of forced labor in Xinjiang and other parts of the country. This forced labor is used in the production of cotton, textiles, and apparel products, which are being imported into the United States. The undersigned organizations are writing to urge you to issue a Withhold Release Order ("WRO") against all cotton, textile, and apparel products from China.

Citizen Power Initiatives for China, one of the undersigned organizations in this letter, has recently released a report entitled, "Cotton: The Fabric Full of Lies: A Report on Forced and Prison Labor in Xinjiang, China, and the Nexus to Global Supply Chains," in which it uses direct evidence from data published by the Chinese government, Chinese companies, and witness testimonies to show that China, the world's largest cotton producer, has built the world's largest forced labor system to provide the workers needed to sustain its cotton production. This "cotton gulag" is primarily based in Xinjiang, home to most of China's Uighers and other Muslim ethnic groups, where 84 percent of China's cotton output is produced.

It is China's long-standing policy to use prison inmates as forced labor, and since the Chinese Communist Party(CCP) took power it has been shipping prisoners from the interior of China to Xinjiang to do hard labor and "contribute to Xinjiang's economic development" in the harsh desert environment. Xinjiang now has the highest percentage of prisoners per capita in China. Excluding Uighur re-education camps, there are over 80 prisons in Xinjiang compared to a mere 25 prisons in Shandong Province, despite the latter having a population over four times larger.

In 2014, the Chinese Government began to implement a strategy to further suppress Uighurs in Xinjiang. Part of the strategy involves the detention of large numbers of Uighurs in so-called "re-education camps" or "vocational training centers." Observers estimate that China has detained over 1 million Uyghurs in this system that is intended to cleanse Uyghurs of their ethnic identity and make them loyal to the Communist Party.

Meanwhile the Chinese Government launched an initiative to spur the development of the vertical integration of China's garment manufacturing sector by moving textile and garment factories closer to cotton production in Xinjiang where Uyghurs could be placed for employment in the cotton/textile/garment industry. Chinese companies involved in textile and apparel production in Xinjiang use these camp inmates to work in their production facilities.

Since 2014, around 2,200 new cotton/textile/apparel companies have been set up to participate in the program. Xinjiang Lihua Cotton Company, a prison enterprise, boasted that they added 8000 new Uighur workers annually. Huafu Fashion and Lutai Textile, both suppliers for international brands such as Target, Burberry, Calvin Klein, Hugo Boss, Armani, Gucci, Olymp, and Uniqlo, have also been active participants in the government program. As of 2018, China documented the new employment of 450,000 Uighur workers from impoverished households, relatives of the convicted and detained, and reeducation camp inmates.

As China continues its mass incarceration of Muslims, and expands the vertical integration of its cotton supply chain, more Uighurs in Xinjiang prisons, reeducation camps, and rural areas serve as a key labor force in every link of China's cotton value chain, from cotton field reclamation, irrigation system construction, planting, harvesting, processing, and garment production.

The United States has the world's most stringent law, the Tariff Act of 1930 as amended by the US Trade Facilitation and Trade Enforcement Act of 2015 ("TFTEA"), when it comes to protecting against the importation of goods made with forced labor. Additionally, the U.S. and China signed two bilateral diplomatic agreements in the 1990s to address U.S. Congressional concerns over China's forced labor issue: a 1992 "Memorandum of Understanding" (MOU) that laid out general principles for stopping bilateral trade in prison labor goods; and a 1994 "Statement of Cooperation" (SOC) that established more specific procedures for site inspections at prison labor facilities suspected of producing goods for export.

In the case of Xinjiang, the evidence is clear. Forced labor is used so ubiquitously throughout Xinjiang that it is difficult to separate Xinjiang's forced labor economy from its regular economy. And because Xinjiang is by far the major supplier for China's apparel supply chain, the U.S. government must assume that any cotton products sourced from China are a product of China's cotton gulag.

Recently U.S. Customs and Border Protection issued a Withhold Release Order on all cotton and products made from cotton that was harvested in Turkmenistan. We believe the same standard should apply to products made by forced labor in China. We therefore urge you to fully enforce the ban on the importation of goods made with forced labor by banning all cotton, textile, and apparel products from China.

Church of Scientology Supports Fix to Elderly Home Detention Pilot Program to Make More Elderly Federal Convicts Eligible for Home Detention.

The Church of Scientology has joined a coalition of 34 groups in support of H.R. 4018, a technical fix to the Elderly Home Detention Pilot Program of the First Step Act.

The pilot program transfers nonviolent offenders in federal incarceration to home detention if they are at least 60 years old and have served two-thirds of their sentence. This legislation clarifies that good time credit applies to the two-thirds calculation, enabling more Americans to spend time with their families and receive any medical attention they need outside of prison while saving taxpayer dollars.

Dear Speaker Pelosi and Republican Leader McCarthy,

On behalf of the 34 undersigned organizations, we write this letter to voice our strong support of H.R. 4018, introduced by Representatives Ted Deutch (FL), Jerrold Nadler (NY), Doug Collins (GA), Hakeem Jeffries (NY), Matt Gaetz (FL) and Karen Bass (CA). This non-controversial bill is a technical fix to the Elderly Home Detention Pilot Program (the “Elderly Program”) of the First Step Act. H.R. 4018 has passed out of the House Judiciary Committee with a strong bi- partisan vote and we urge you to advance this legislation as soon as possible.

Our federal prisons are looking more and more like old-age homes. It is inhumane, and it is unsustainable. It is a crisis that deeply affects us fiscally, and more importantly, goes to the core of who we are as Americans.

The United States Inspector General, Michael Horowitz, found that “According to BOP data, inmates age 50 and older were the fastest growing segment of its inmate population, increasing 25 percent from 24,857 in fiscal year (FY) 2009 to 30,962 in FY 2013.” The human cost is reprehensible. But the fiscal cost is equally irresponsible. Mr. Horowitz further writes, “Based on BOP cost data, we estimate that the BOP spent approximately $881 million, or 19 percent of its total budget, to incarcerate aging inmates in FY 2013.” This is untenable.

This is why we supported the Elderly Home Detention Pilot Program in the First Step Act, passed into law this past December. This program transfers nonviolent federal individuals in prison to home confinement if they are 60 years-old or older and have served two-thirds of their sentence. Obviously, home confinement is much cheaper for the taxpayer than housing and feeding someone in a prison. It further goes without saying that the medical care available on ‘the outside’ is incomparably better than the mediocre medical care available in prison.

The problem is that the two-thirds is currently interpreted to be 2/3 of the original sentence, not 2/3 of the sentence with good time credit included.

The issue stems around the language of the statute. The language in the Second Chance Act of 2007 is “of the term of imprisonment to which the offender was sentenced.” Based on this language, when BOP conducted this elderly pilot program in 2010, it calculated the 75% of the sentence as the full sentence imposed by the judge, without good time included. [1]

The challenge is that back in 2010 this question was reviewed by the judicial branch and the Tenth Circuit Court of Appeals agreed with the BOP that the statute does not include good time credit -- Mathison v. Davis and Izzo v. Wiley, 620 F. 3d 1257 (10th Cir. 2010). In light of this case, the BOP has concluded that this is how it is obligated to calculate the 2/3 requirement under the First Step Act.

It is clear the only way to fix this is legislatively. Congress must clarify the language to show that the 2/3 calculation should include good time credit. Hence, the need for H.R. 4018, which is a technical fix that clarifies what was probably a drafting error so that these eligible elderly incarcerated individuals, who were “model inmates” that followed the rules, should receive good time credit like everyone else.

This technical fix is the right thing to do for the following reasons:

1) The current method is a departure from the way BOP calculates all other transfer decisions. For each transfer and release decision—except those in the “Elderly and family reunification for certain nonviolent offenders pilot program”—BOP always calculates good conduct time credits. As soon as a federal offender arrives in the custody of BOP:

• His/her projected release date is determined by taking the term of imprisonment to which he/she was sentenced and subtracting the maximum number of good conduct time credits they can possibly earn and accrue.

• Working back from this projected release date, BOP then determines the projected dates of transfers from higher to lower-security and supervision facilities. For example: when BOP calculates when an offender will become eligible to transfer from a “Low-security” facility to a “Camp”; and from a “Camp” to a “Residential Reentry Center,” etc....with all these examples, the calculation of the release date is with good time included. There is no reason that elderly transfer should be treated differently.

2) Moreover, this is an issue of fairness. Why should these elderly men and women lose their good time credit when they did in fact act with good behavior? It would not be fair to penalize them and would counter the compassionate purpose of this provision.

3) One of the goals of this program is to save taxpayer dollars. (In fact, one of the eligibility factors is that the “release to home detention under this section will result in a substantial net reduction of costs to the Federal Government”.) Obviously, the older incarcerated individuals get the more it costs to house them in prison. Hence, getting them to home confinement earlier -- by including good time -- will result in tremendous savings to the Federal Government.

Based on these important factors, we urge all members of Congress to vote in favor of H.R. 4018. It will have a truly positive impact on the lives of these elderly human beings and their families, not to mention it will save much needed federal dollars housing these nonviolent people who have the least risk of recidivating.

RE: Support a Second Look at long sentences through H.R. 3795/S. 2146

Dear Congressperson:

No other country imposes life imprisonment or decades-long incarceration on its population to the degree it is imposed in the United States.[1] Reams of criminological evidence demonstrate that this reliance on long sentences produces diminishing returns on public safety, substantially contributes to mass incarceration, and perpetuates racial disparity in the criminal justice system.[2] Thus, the Justice Roundtable, represented by the undersigned organizations, urges you to cosponsor the Second Look Act (H.R. 3795/S. 2146), introduced by Representative Karen Bass and Senator Cory Booker, to restore more proportionality in federal sentencing by reexamining excessive prison terms, and allowing for release in cases of redemption and transformation.

The Second Look Act would allow judges to consider petitions for sentence reductions after a person has served at least 10 years. To grant release, the court must find that the person is not a danger to public safety and demonstrates readiness for reentry, and that the interests of justice warrant a sentence modification. Petitioners who are 50 or older would have a rebuttable presumption of release.

A case in point is Matthew Charles, who received a standing ovation from members of Congress when President Trump introduced him at the State of the Union in February and welcomed him home. Sentenced to 35 years, Mr. Charles served over 20 years in federal prison before being released due to the newly-enacted First Step Act’s retroactive sentencing reform. He has gone on to become an inspiring advocate for change and is a reminder of the lost potential locked away in federal prisons.

Criminal behavior is most common during teenage years and tapers off during young adulthood.[3] Incarcerating people after they have aged out of their crime-prone years comes at great expense. Long sentences add little deterrent effect on crime. Research shows that deterrence is a function of the certainty of punishment, not its severity.[4] Long sentences are also costly and impede public investments in effective crime prevention, substance use treatment, and other rehabilitative efforts that produce healthier and safer communities.

When Congress ended federal parole and established a determinate sentencing system, the federal prison population was 49,378.[5] It has increased 260% since then, and half of the people in prison are serving a sentence longer than 10 years.[6] Overcrowded federal prisons and staffing shortages have contributed to dangerous conditions and limited opportunities for rehabilitation. The Second Look Act provides an opportunity to safely reduce our prison population by alleviating our bloated prison system of wasteful and ineffective sentences.

We urge you to cosponsor the Second Look Act (H.R. 3795/S. 2146) to ensure more fairness and effectiveness in our federal justice system.

From our various experiences, the Commission has played a vital role in supporting those around the world who suffer for their beliefs, conscience, or religion. Robust reporting products, advocating for prisoners of conscience, and resources such as prisoner lists are essential tools used often by civil society to advance this fundamental human right, which is a foreign policy priority of the United States as defined by Congress in the IRF Act of 1998.

Additionally, the value to a person who has been persecuted of being heard and respected by an official of the United States Government and then to have their story told in official documents cannot be overstated. The U.S. House of Representatives passed a bipartisan criminal justice reform bill Tuesday that would enable prisoners age 60 and older to be released to home confinement if they meet certain qualifications.

In a voice vote, the House unanimously passed H.R. 4018, which would amend the bipartisan First Step Act signed into law by President Trump last year. The bill would clarify how much time a federal prisoner must serve before being eligible for placement in home detention.

H.R. 4018 would give the Bureau of Prisons authority to transfer eligible, elderly offenders from a BOP facility into home confinement when they reach age 60, as long as they have served two-thirds of their sentence.

The legislation clarifies that the two-thirds of a sentence that an eligible inmate must serve is to be reduced “by the number of good time credits earned by the prisoner, and for other purposes.”

Reform advocates took issue with the fact that the First Step Act was interpreted by the BOP to mean two-thirds of an offender’s original sentence, not two-thirds of an offender’s sentence with good time credit.

Dear Mr. President,
Washington, D.C.

We write today to express our concern regarding the religious freedom situation in India. We ask that you raise the situation of religious persecution of Christians and other minorities in India as you meet with Prime Minister Narendra Modi in private and in public during your upcoming visit to India.

The United States and yourself, Mr. President, have made a clear stand for religious freedom not least during your remarks at the US-led United Nations General Assembly event on Religious Freedom. We ask that you stay true to your promises and religious freedom commitments.

The religious persecution carried out by the government of Prime Minister Modi is not restricted to Indian citizens alone, US citizens who work for Christian organizations are regularly deported and or denied entry upon arrival at Indian airports. As recently as October 2019, police arrested a US Pastor 1 from Tennessee, Bryan Nerren in Bagdogra airport in Northeast India. The police arrested him on the grounds of failing to declare funds after they had interrogated and cleared him in New Delhi, asking him if he was Christian and if the money was for Christians or Hindus. Authorities have confiscated the pastor’s funds and passport and while he has now been released, he is still waiting to receive his passport. Senator Alexander and Senator Blackburn are working on his case. The boldness of the authorities’ arrest and discrimination of a US national because of his faith – shows that actors of religious persecution in India, afforded government impunity, further emboldens state and non-state extremists to continue their discriminatory and abusive actions towards non-Hindus. Last year, the Chief of Immigration at Chennai airport deported a team of Episcopal Pastors from the Council of Churches (USA) visiting Chennai and threatened that he will not let another American Christian enter his country again.

We are concerned about how mob violence, which includes severe beatings, harassment and threats of Christians, Muslims and other non-Hindus; are not addressed or prosecuted by the local governments or police. According to Open Doors, at least 1497 Christians were attacked from November 2018 to October 2019. When individuals go to report their cases they themselves often get arrested or questioned. In addition, police have used excessive force against demonstrators protesting the Citizenship Amendment Act, including many students. Within a week of its introduction in December 2019, 25 deaths were reported, all in states governed by the Prime Minister-led Bharatiya Janata Party 2

In January 2020, in the state of Andhra Pradesh, attacks and harassment by upper-caste Hindus led a 40-member church congregation to stop meeting. Local Hindu extremists there beat the pastor badly as the extremists were trying to build a wall outside the pastor’s home to block church members from attending worship services. A first information report was filed with the police but there has been no 3 arrest. Another similar case happened in Southern India, where Hindu extremists interrupted a Church service taking photos of the Christian children, claiming forced conversions; when the children asked them to stop, the Hindu extremists beat up the Christian children and then they filed a police complaint against the congregation. These laws together with the anti-cow slaughter laws have been used discriminatorily against non-Hindus and Dalits. According to Human Rights Watch, extremist Hindu groups have killed 50 people and injured over 250 in response to rumors they trade or have killed cows for beef since May 2015; including Muslims who were also beaten and forced to chant Hindu slogans. Anti-conversion laws have been implemented in Orissa, Madhya Pradesh, Chhattisgarh, Gujarat, Himachal Pradesh, Jharkhand and Uttarakhand states, all during the time when Prime Minister’s BJP party is/was in power.

Unfortunately, every single time, citizen tribunals have found that the mob belongs to the ruling party, BJP and its affiliated organizations. Due to the erosion of rule of law, its leaders enjoy total immunity 5 Far-reaching legislations introduced by Prime Minister Modi’s government affecting longstanding secular and liberal values of India has the potential to create large scale civil unrest in India, as has been documented. Such unrest could be very detrimental to the interest of the United States not only in India but also across the region from Afghanistan to Indonesia if not beyond.

While we should develop economic and trade opportunities for US companies in India, we must also do that without compromising our cherished values or undermining our commitment to protecting over 100 million people who practice Christianity in India besides the over 200 million other religious minorities.

In conclusion, President Trump, at the United Nations General Assembly (UNGA), you urged every nation to, “increase the prosecution and punishment of crimes against religious communities,” we respectfully ask, therefore, that you raise the issue of impunity regarding mob violence against

incident, the police tried to find fault with the Christians for using their home as a place of worship. These cases are not isolated, mob violence and discrimination when reporting the violent incidents to the police are common. for their violence against Christians and other religious minority groups.

Christians and religious minorities India with Prime Minister Narendra Modi. Please also raise the case of the US pastor, the anti-conversion laws, and urge the government of India to show itself willing to enact and enforce policy to protect religious liberty for all.

As you promised in UNGA, “no matter the case, America will always be a voice for victims of religious persecution everywhere.” We ask that you do not let the voices of persecuted Christians, Muslims and other religious minorities in India go unheard.

Dear Senator Risch,

We write as an informal group of 63 organizations and individuals who are scholars, religious and secular leaders, human rights advocates and practitioners who have joined our voices to respectfully urge you to speak out for Mr. Ramy Kamel, a prominent Coptic Christian activist. Kamel has been the primary source of information for NGOs and individuals around the world working to improve religious freedom in Egypt.

Kamel has reported objectively on mistreatment of Copts in Egypt, documenting rights abuses and advocating for those who have been displaced from their homes due to faith-based persecution.

Mr. Kamel was invited to participate in a UN forum (November 28th and 29th) titled Education, Language, and the Human Rights of Minorities as a leading advocate and as an individual who met and collaborated with the UN Special Rapporteur on adequate housing, Leilani Fahra, when she visited Egypt in September 2018.

On November 23rd, Mr. Kamel was arrested under the cover of dark, around 1:30AM. He was beaten and interrogated without legal representation at the Supreme State Security Prosecution in Cairo’s Fifth Settlement neighborhood.

Just 18 days earlier, he was arrested, transferred in an armored vehicle to National Security headquarters in Nasr City, and severely beaten and tortured. He was interrogated without legal representation in an effort to compel him to reveal his research sources, and likely to intimidate him prior to participating at the UN Forum.

Rights groups almost universally agree that Kamel’s arrest is a direct effort by the Egyptian government to punish and silence him for documenting and publicizing human rights abuses against Coptic Christians. In 2011, Kamel founded the Maspero Youth Union after the infamous Maspero Massacre in which 27 Copts were killed by the Egyptian military while peacefully protesting a church closure.

The Special Rapporteurs and Working Groups, which compose the Special Procedures of the Human Rights Council, issued a statement urging Kamel’s release stating:

“We urge the authorities to comply with their obligations under international law to
provide effective remedies to victims. Egypt must immediately free Mr. Kamel, lift all charges against him, and conduct effective investigations to ensure that those responsible for the violations, including any act of torture, or other cruel, inhuman or degrading treatment or punishment, are prosecuted and punished.”

Without credible proof, Mr. Kamel was charged by the State Security Prosecution with disturbing the public peace through the misuse of social media and spreading false news, and with joining and financing a terrorist group. He denied all these charges.

Egypt is a signatory to the UDHR and ICCPR and a member of the United Nations. It is reprehensible that an Egyptian citizen be arrested and tortured merely for exercising rights, guaranteed by these bodies and the Egyptian Constitution.

Mr. Kamel’s detention has been automatically renewed at each of his hearings without cause. This flagrant violation of justice adds weight to the international media reports about the Egyptian government’s widespread crackdown against human rights advocates and opinion-writers within Egypt.

Mr. Kamel’s case is another example that validates other numerous claims of torture by National Security. It is imperative that all government officials and security personnel involved in such unlawful torture and interrogation without legal representation be brought to justice.

Kamel is reportedly suffering from severe respiratory distress. Given the recent death of American/Egyptian dual citizen, Moustafa Kassem, while imprisoned in Egypt, and the credible reports of Egyptian prisoners being denied medical attention, Kamel should receive urgent medical care.

The United States can and should maintain a strong relationship with Egypt, while simultaneously advocating its values of human dignity and religious freedom. Considering Egypt is the 2nd largest recipient of US foreign aid, Members of Congress should be forcefully advocating for Kamel’s immediate release.

Please take urgent action by contacting the Egyptian government and ask for immediate protection of Mr. Kamel from mistreatment, the provision of medical attention, and the termination of all charges against him in Case no. 1475 of 2019.

The 68 undersigned organizations are writing to urge the Federal Bureau of Prisons (BOP) to include certain demographic information in its daily reporting[1] of COVID-19 cases within federal facilities. When publicly reporting each day, BOP should include the age, race, ethnicity, religion, gender, gender identity, sexual orientation, and disability for incarcerated persons and staff who have contracted, recovered from, and died from COVID-19. BOP should also include this same demographic information in its reporting of people released to home confinement. Additionally, BOP should be reporting the number of people released through compassionate release with demographic information.

BOP is currently providing data on the number of COVID-19 cases among those incarcerated and staff. Each day, at approximately 3:00 p.m. (EST), BOP reports the number of incarcerated persons and staff who have contracted, recovered from, and died from COVID-19. BOP also indicates how many federal facilities and residential reentry centers (RRCs) have been impacted, as well as the number of people who have been released to home confinement.[2]

As of April 20, BOP reports 497 incarcerated persons and 319 staff tested positive for COVID-19. Twenty-two incarcerated persons have died. Among these numbers, BOP reports 238 people have recovered from COVID-19. Almost 40 percent of BOP prisons are impacted, with 45 of 122 facilities indicating COVID-19 cases. Another 14 RRCs have positive cases. To date, a little over 1,280 people have been moved to home confinement.[3]

Without demographic information, however, these numbers do not present an accurate picture of the COVID-19 impact on federal prisons. Furthermore, we understand that BOP’s reporting is an undercount given the varied and insufficient testing protocols throughout facilities.[4] BOP has acknowledged that its current reporting will merely provide “insight.”[5] Therefore, BOP should flesh out this data with information on age, race, ethnicity, religion, gender, gender identity, sexual orientation, and disability. BOP should also clarify whether the data point on positive tests includes those incarcerated persons and staff who have recovered from COVID-19. If BOP is deducting recoveries from positives, it should state that clearly on its website.

Additionally, with 70 percent of the BOP population being Black[6] and Latinx,[7] we are concerned that people of color will bear the brunt of COVID-19 outbreaks in federal facilities. Also, with BOP’s reliance on the PATTERN risk assessment tool to identify people for home confinement, we are concerned that people of color will be disproportionately excluded for such release.[8] According to a National Institute of Justice (NIJ) analysis of PATTERN, just 7 percent of Black men, in comparison to 30 percent of White men, would be classified at the minimum risk level that BOP is using to identify who is eligible for home confinement in the wake of COVID-19.[9] Finally, with women now the fastest growing segment of the incarcerated population,[10] we are concerned that they could be disproportionately represented among COVID-19 cases in BOP. Demographic data can help respond to these concerns.

With recent reports indicating that COVID-19 is disproportionately impacting Black people, elected officials have called for health agencies to collect and report demographic data on COVID-19.[11] We are asking BOP to do the same. Again, in a manner consistent with privacy laws, BOP should include in its daily, public reporting the age, race, ethnicity, religion, gender, gender identity, sexual orientation, and disability for incarcerated persons and staff who have contracted, recovered from, and died from COVID-19. BOP should also provide data on home confinement and compassionate release, along with demographic information, in this accounting.

Dear President von der Leyen,

We, the undersigned organizations and individuals, are writing to applaud your commitment to universal human rights and the rule of law, and respectfully request that the EU continue to lead on the promotion of human rights throughout the world by continuing the mandate of the Special Envoy for the promotion of freedom of religion or belief outside the EU.

Many of us are participants in the U.S.-based International Religious Freedom (IRF) Roundtable.

With ten years of continuous operations, the IRF Roundtable is an informal group of individuals from non-governmental organizations who gather regularly to discuss the most pressing issues facing communities and individuals of all faiths and no faith, when they have their right to

freedom of religion or belief violated. Further, the IRF Roundtable is a multifaith venue for collaboration to advance the right to freedom of religion or belief, which is a fundamental human right for everyone, no matter his or her specific faith. The IRF Roundtable and its participants have been fortunate to be able to work extensively with the Special Envoy for the promotion of freedom of religion or belief outside the EU, and have been deeply grateful for the work that the EU has done to promote freedom of religion or belief throughout the world. The EU’s advocacy has borne real fruit for so many victims who have been targeted for their religion or belief.

In the constellation of human rights, freedom of thought, conscience and religion plays a central role, as the basic ability of any human being to think and act according to his or her beliefs.

However, these freedoms have come under increasing attack over the past decade. According to the Pew Research Center’s latest annual study on global restrictions on religion, 83% of the world’s population lived in countries with high or very high levels of restrictions and/or hostilities in 2017, up from 79% in 2015, 74% in 2014 and 68% in 2007. These freedoms are undermined and threatened in many parts of the world, whether in the form of blasphemy and anti-conversion laws, severe restrictions on freedom of expression and the free practice of religion, or physical attacks on people targeted because of their religion or belief—such as Muslims in New Zealand, Christians in Sri Lanka, Jews in San Diego, or the ongoing crises involving the Rohingya in Myanmar. Even now, countless prisoners of conscience, among them those imprisoned for their religion or belief, languish in appalling circumstances, exceptionally

vulnerable to diseases like COVID-19. These individuals need the voices of the international community.

The EU must stand strong and united in order to respond to these challenges. The EU must stand together in the face of these unprecedented attacks on universal human rights. With its Special Envoy, the EU has led in the international response, and that leadership is needed now more than ever. We sincerely hope that the EU will continue the role of the Special Envoy, and even strengthen the tools available in this regard, so that the EU’s necessary voice on universal human rights will continue to play a key role in the growing international movement for the protection of religion or belief for all people everywhere.

We again applaud your leadership, President von der Leyen, on universal human rights, and humbly request that the continuation of the Special Envoy for the promotion of freedom of religion or belief outside the EU will be a priority in the EU’s deliberations in the coming months.

Dear President Tichy-Fisslberger,

We, the undersigned individuals, represent a myriad of religious, economic, intellectual, and political backgrounds, who collectively strive to promote and protect fundamental human rights as well as the international standard of freedom of religion or belief. We would firstly like to recognize your dedication to human rights leadership, which is both admirable and timely amidst the outbreak of a global pandemic. It has come to our attention that China has been nominated and selected for a one-year mandate as a member state of the United Nations Human Rights Council (UN HRC) Consultative Group, a group consisting of five UN member states whose ultimate purpose is to review applications and suggest recommendations to independent UN experts, whom the member states are required to review based on the following six criteria: (a) expertise; (b) experience in the field of the mandate; (c) independence; (d) impartiality; (e) personal integrity; and (f) objectivity.

China is a nation recognized by the broad international humanitarian community to be a routine violator of human rights, most notably: freedom from involuntary servitude; freedom from torture and other cruel, inhuman or degrading treatment or punishment; freedom from arbitrary arrest, detention or exile; freedom from interference with his privacy, family, home or correspondence; freedom of thought, conscience and religion; freedom of opinion and expression and; freedom of peaceful assembly and association.

We find it problematic and reprehensible that a country whose government does not follow international human rights laws nor meets its obligations as a member State of the United Nations should be considered for, let alone chosen as a member of the UN HRC Consultative Group, especially considering its plethora of human rights abuses. A great concern is the possibility that China’s own oppressive ideology could be inherently exported into the initiatives and decisions of the United Nations and thus diminish any semblance of impartiality and neutrality. Secondly, we fear that China could use this new power to preferentially nominate and approve experts based on partisanship and nepotism rather than on their human rights expertise and objectivity. In short, China will have the power to nominate experts that will investigate China’s own human rights record- introducing bias into the United Nations human rights review procedures. Finally, we are concerned that this action will create a precedent in which China’s historical human rights abuses will continue to be overlooked in favor of ensuring its inclusion and participation in the United Nations’ future initiatives.

Among the experts that China will have a voice in vetting and choosing are three new members of the UN Working Group on Arbitrary Detention. We wholeheartedly believe that China should have no say in such a decision given its historical pattern of detention and disappearance as a means to eradicate political dissent among scholars and humanitarian activists. In 2018, Chinese human rights lawyer Yu Wensheng was arbitrarily detained and his attorney status revoked. A year later, the UN Working Group on Arbitrary Detention released its decision that “there was no legal basis for the arrest and detention of Mr. Yu, and his deprivation of liberty is arbitrary under category I.” It is completely impermissible that China should have the authority to choose experts for the UN Working Group on Arbitrary Detention, which has historically been involved in condemning and classifying China’s acts of arbitrary detention and deprivation of liberty. Such a drastic oversight has the potential to eliminate the credibility and distort the purpose and mandate of the Working Group and allow China to avoid any investigations into its own deplorable human rights record.

Another one of the 17 appointments that the UN Human Rights Council Consultative Group will choose is the Special Rapporteur on the promotion and protection of the right to freedom of opinion and expression. Freedom of opinion and expression is regularly violated in China; students, scholars, organizations, and activists who publicly proclaim views contrary to the CCP face imprisonment and exorbitant charges. 2019 saw the noteworthy arrests of three individuals: Zi Su of Chengdu for his article questioning the sustainability and adequacy of President Xi Jinping’s leadership of the CCP; activist Huang Xiaomin, also of Chengdu, for his promotion of direct elections for CCP leadership positions, and; Chen Yunfei for his online support of Hong Kong’s anti-extradition protests. A nation who unabashedly imprisons individuals for their valid beliefs and critiques of the government should not be authorized to have the power of choice over the selection of the Special Rapporteur on the promotion and protection of the right to freedom of opinion and expression.

Amidst the persistent and unmitigated spread of the novel coronavirus, which originated in Wuhan, Hubei Province, China, we also find it extremely inappropriate and unacceptable that China be involved in the vetting and selection process for the new Special Rapporteur on the right of everyone to the enjoyment of the highest attainable standard of physical and mental health. In December 2019, ophthalmologist Dr. Li Wenliang of Wuhan Central Hospital, the initial “whistle-blower” regarding the novel coronavirus, warned a small group of his friends about the emergence of a SARS-like virus among a few of his patients. After his warning was spread to the mass public, he was severely reprimanded by the Wuhan Public Security Bureau for spreading ‘false information’ online and causing public concern. He was among eight other doctors in Wuhan who similarly began warning close individuals about the suspicious new cases and who were condemned as “rumormongers.” China had the sufficient time and capability to respond to the outbreak before it gained momentum and cost many Chinese citizens their lives before being exported to nearly every nation in the world, save for a few countries in South America and Africa. China’s refusal to acknowledge the rise of COVID-19 and subsequent refusal to acknowledge its responsibility for the prevalence of the new pandemic exhibit its failure to prioritize public health and therefore disqualifies China as a suitable member of the UN HRC Consultative Group.

Such an appointment comes as a surprise to us as well, considering the already-strained relationship China has with the United Nations and its selected rapporteurs and representatives. In December 2019, UN Human Rights Chief Michelle Bachelet wrote an article that the use of force by Chinese police against Hong Kong protesters is extraneous and should be investigated. In response, China claims her statements include “inappropriate comments on the situation of the Hong Kong Special Administrative Region” and “interferes in China’s internal affairs.” Moreover, when 23 United Nations member states supported a statement in October 2019 denouncing the detention of Uyghurs and other ethnic Muslim communities in Xinjiang, China’s Foreign Ministry Spokesperson Geng Shuang urged the United States and United Kingdom to “stop interfering in others’ domestic affairs under the cover of human rights…” How can a nation that accepts no criticism of its human rights record and refuses to address the mass imprisonment of millions of citizens for no reason other than their ethno-religious background be a legitimate and reliable leader in the UN Human Rights Council Consultative Group? In addition, China is included in the 2019 UN Secretary-General report on intimidation and reprisals for cooperation with the UN in the field of human rights. It is absurd to have a country who targets activists and human rights defenders who engage with United Nations human rights mechanisms to then be allowed to have influence over those mechanisms which they have been working against.

It is with the above objections in mind that we condemn the designation of China as a member of the UN Human Rights Council Consultative Group. We ask that if the position cannot be reconsidered, that you as President take note of these voiced concerns during China’s one-year term, as you review upcoming proposed candidates by the UNHRC Consultative Group, to ensure the priorities suggested by the group are in line with the commitments of the Council. We ask that you be prepared, as President, to not follow the priority suggested by the group if there is any risk that the expert will be partial or restricted to speak freely, to ensure the integrity and credibility of the Human Rights Council and the future of international human rights.

Dear Administrator Carranza:

The undersigned organizations offer these comments on the Small Business Administration’s recently released Interim Final Rule for the Paycheck Protection Program (PPP) and the Business Loan Program. We urge the SBA to reconsider those provisions of the Rule that discriminate against individuals who have a record of arrest or conviction.

Specifically, we call upon the SBA to modify or rescind provisions of the Interim Final Rule that make individuals ineligible for PPP loans based upon current or prior criminal history, or ongoing criminal proceedings. Under the Rule, any individual who owns 20% or more of the equity of a business applying for a PPP loan is ineligible for that loan if they are presently incarcerated, or on probation or parole, or subject to an indictment, criminal information, arraignment, or other means by which formal criminal charges are brought in any jurisdiction.

Additionally, per this Interim Final Rule as supplemented by the PPP application form, any owner of a business is ineligible for the loan if they have in the last 5 years 1) been convicted; 2) pleaded guilty; 3) pleaded nolo contendere; 4) been placed on pretrial diversion; or 5) been placed on any form of parole or probation (including probation before judgment) in a felony case.

These requirements are needlessly restrictive and unfairly discriminatory and jeopardize thousands of local communities and employees who rely upon these businesses and their owners for employment and services. The intention of the emergency relief programs authorized by the CARES Act is to sustain small businesses that are trying to save the economy by keeping people employed. Eligibility requirements should be relaxed in these circumstances, not heightened as

SBA proposes. SBA’s new restrictions on eligibility for its loan programs, which already operate to exclude many people with a record, contravene the intent of the CARES Act, and are inconsistent with SBA’s more general mandate of encouraging entrepreneurship and expanding access to employment.

A significant number of people with arrest or conviction history have established their own small businesses, since it is frequently difficult for them to secure employment with others. Moreover, these businesses also tend to be more willing to hire employees with a record. Driving them out of business will result in a severe impact on employment of a population that is already disadvantaged in the workplace. People with a record are subject to a myriad of disadvantages in seeking to reintegrate into society, notably in bank lending policies but also in housing, employment, licensing, education, voting, and other areas.

The SBA’s restrictions will have an adverse impact on minority business owners and employees, who are arrested and convicted at disproportionately high rates due to institutional racism, ensuring that business owners of color will be disproportionately excluded from critical economic assistance.

The Interim Final Rule and PPP application form present a wholly unsubstantiated departure from prior SBA practice and are in tension with the statutory directives in the CARES Act, which provides that “any business concern … shall be eligible” for a loan guarantee if it has the requisite number of employees.

Even the SBA’s pre-existing 7(a) regulations include criminal history disqualifications that, while still troubling, were more narrowly drawn.2 The SBA has issued no rationale for its expansion of these mandatory disqualifications to all recent felony convictions, criminal charges of any kind, and a variety of non-conviction dispositions. In summary, the agency’s choices are misaligned with Congressional intent regarding eligibility, inexplicably depart from prior practice, and are unsupported by any explanation.

While we call upon the SBA to modify or rescind all of the provisions relating to criminal history in the Interim Final Rule, we urge the SBA to immediately remove the provision disqualifying individuals who have merely been indicted or arraigned for a crime, or who have otherwise not been convicted. Punishing individuals who have not been convicted of wrongdoing in a court of law is fundamentally unfair and jeopardizes the economic well-being of thousands of employers and employees.

We also urge the SBA to rescind the 5-year ineligibility period for individuals convicted of a felony, or who have been placed on pretrial diversion/probation/parole for any crime. To the extent that the SBA has authority to promulgate eligibility requirements for the PPP that are related to a history of arrest or conviction,3 those requirements should be limited to felony convictions for financial fraud from the past 3 years, subject to an individualized assessment and waiver in appropriate cases. This narrowing of potential ineligibility to serious convictions that are directly related to qualification for financial assistance, along with a diminished window, ensures that individuals who were convicted of a crime but have worked to reintegrate into society are not unduly punished for a past offense.

Finally, we urge the SBA not to disqualify people who are currently serving a sentence of parole or probation in the community unless they are within the narrow category of felony financial fraud convictions within the past 3 years. Parolees and probationers should also have an

Church, at *6, “While a borrower's bankruptcy status clearly is relevant for a normal loan program, the PPP is the opposite of that. It is not a loan program at all. It is a grant or support program. The statute's eligibility requirements do not include creditworthiness.”

opportunity to obtain relief, to ensure that their employees will be able to retain their jobs during this ongoing crisis.

At the very least, the SBA should remove the unauthorized additional restrictions on its application form—restrictions not called for in the Interim Final Rule itself—that apply to any owners convicted in the last 5 years, not simply those who own 20% or more of the business, as well as those provisions on the application form that exclude people who were placed on pretrial diversion or probation before judgment in the past 5 years.

In summary, we urge the SBA to reconsider and modify discriminatory PPP eligibility rules, which jeopardize workers, local communities, and individuals who have come into contact with

the criminal law system but are working to employ local workers and to reintegrate into society.
