Yesterday afternoon, we told you the breaking news, that the Second Appellate District had upheld a lower court’s ruling that denied Scientology’s attempt to gut the civil lawsuit filed by Danny Masterson’s victims.
Now, we’ve had a chance to go through the full 64-page ruling so we could post it here.
Once again, if you’re just joining us, this is a civil lawsuit that we’ve been watching since it was first filed in August 2019, even before criminal charges were filed against Masterson (and that eventually led to two trials and Masterson now serving 30 years to life in prison).
The civil lawsuit was about the harassment that the Jane Doe victims said they’d been going through since coming forward to the LAPD, and that they believed was a coordinated campaign run by Scientology and Masterson.
The lawsuit was on hold during Masterson’s trials, but after he was convicted and the lawsuit resumed, Scientology filed its anti-SLAPP, trying to have much of the case struck by arguing that the Jane Does hadn’t proved the harassment was being caused by the church.
Judge Upinder Kalra denied the motion, saying that the women had alleged enough at this early stage in the process, and so Scientology appealed Kalra’s ruling. Now, take a look at how the appellate court views it as it upheld Kalra’s ruling, but did find that a couple of sentences in the 58-page complaint should be struck.
In other words, a nearly total victory for the Jane Does, who can now go back to Judge Kalra’s court, where they want him to rule on their new proposed complaint, that will add another plaintiff, sexual batter allegations against Masterson, and civil racketeering allegations against Scientology. It’s going to be huge.
