The civil lawsuit against Danny Masterson and the Church of Scientology alleging harassment of Masterson’s victims now has an oral arguments hearing date at a California appeals court, and it will take place on Tuesday, March 3 at 9 am Pacific.
The case has been on appeal after Scientology challenged a preliminary ruling by Los Angeles Superior Court Judge Upinder Kalra, who had denied the church’s attempt to gut the lawsuit in an anti-SLAPP motion.
During briefing on the appeal, however, attorneys for the Jane Doe victims submitted a pleading that turned out to have hallucinatory AI-generated case citations, which Boies Schiller partner John Kucera said he accepted blame for.
The court denied Kucera’s motion, however, in which he offered a corrected brief that would have taken out the AI-created errors.
So there will be a lot for us to watch during this hearing, which should be streamed online so that members of the public can watch.
How hard will the justices come down on Kucera for the AI blunder? How much of the Jane Does’ arguments will be disregarded because of those AI errors? Will this court, which has been tough on Scientology in the past, see past the AI issues and, like Judge Kalra, find against Scientology’s objections to his ruling, leaving the Jane Does and their lawsuit in a strong position?
