Applicant James R. Fonda has filed a Notice of Appeal with the Trademark Trial Appeal Board from the denial of the trademark application for the "First Independent Church of Scientology."

Because it is now buried in the original ESMB, I want to again note that the First Independent Church of Scientology is represented by the law firm of Roca Rothgerber Christie LLP and in particular by attorney Raymond R. Tabandeh, who signed the brief. They are well-regarded attorneys who specialize in trademark law. These are not lightweights, and one would assume they are expensive.

The Examining Attorney has filed their Appeal Brief with the Trademark Trial Appeal Board in support of denial of the trademark application for the "First Independent Church of Scientology." This brief is in response to the opening brief filed by Applicant James R. Fonda noted above.

The 501(c)(3) tax-exempt status of the First Independent Church of Scientology has been revoked for not filing a Form 990-series return or notice for three consecutive years.

In contrast and for comparison, the Independent Scientology Religious Liberty League had its 501(c)(3) tax-exempt status revoked and reinstated on the same day, 5/15/19. Also, unlike the First Independent Church of Scientology, the Religious Liberty League has an entry indicting it is on the Publication 78 Data List of tax-exempt organizations with a destructibility code of PC (i.e.. public charity).

By a decision mailed on March 20, 2020, the United States Patent and Trademark Office Trademark Trial and Appeal Board affirmed the denial of the trademark application for the First Independent Church of Scientology.

I don't know if the applicant, James R. Fonda, is seeking further review.
On 6/24/20, the USPTO issued a Notice of Abandonment of the trademark application for the First Independent Church of Scientology.

Given the history memorialized above, it is clear the reason the Notice of Abandonment was issued was:

"(3) The TTAB affirmed the trademark examining attorney's refusal to register the mark."
