The habeas petition that Danny Masterson’s attorneys have been promising since he was sent to prison in 2023 is finally here, and we have the whole thing for you.

This is a separate action from his criminal appeal, but it’s asking the same appellate court to consider numerous arguments in order to ask for an evidentiary hearing in Judge Olmedo’s trial court.

There’s a lot to consider here and we’ve only begun to consider it all, but the first thing that jumps out at us is that attorney Eric Multhaup argues that Masterson did not receive adequate counsel from his defense attorney Philip Cohen, because he says that Cohen mainly failed to call a number of witnesses who might have impeached the Jane Doe victims and their testimony.

What Multhaup is not saying, however, is that the witnesses and documents he’s holding up as evidence of Cohen’s weak defense are nearly all Scientologists or Scientology documents, and it would have been fairly easy for the prosecution to call their credibility into question.
