Danny Masterson was sentenced to 30 years to life in prison in September 2023, and since then his attorneys have been working on trying to overturn that conviction.

In January, they submitted his “opening appeal brief” to California’s 2nd Appellate District, and our expert TX Lawyer found it professional and well-written, but criticized its focus on the accounts of the Jane Doe victims.

In August, the California Attorney General’s office answered with a “respondent’s brief,” which TX Lawyer thought was a pretty overwhelming comeback to Danny’s appeal.

Now, Masterson completes the briefing with his “appellant’s reply brief,” which answers the arguments of the state AG. We have the entire thing for you below.

And it showed up just about the same time that Masterson’s lawyers also filed a habeas petition, arguing that Masterson received ineffective counsel during his trial, and they also attacked the amount of focus on Scientology, of which Masterson is a celebrity member.

Some of the findings of the habeas petition are mentioned in today’s brief, and tomorrow TX Lawyer will help us understand the difference between the two approaches — the direct appeal and the habeas petition — and the signs suggesting that they are both being influenced by Scientology itself.

For now, here’s the appellant’s reply brief, which completes the briefing in Masterson’s direct appeal, and we’ll be waiting to see when a hearing is scheduled.

Summary: His attorneys are throwing every piece of irrelevant and dubious protest against the wall in the desperate hope that something will stick, and forwarding the C of S party line that mention of Scientology was inappropriate and grounds for appeal.
For instance, "the police admonished the defendants not to speak to each other, and they violated that admonishment":
Trying to make "admonishment" sound like its a crime to do otherwise. It isn't. And when someone has not only been raped, but was then being gaslighted about it, they are going to be desperate to find correlation and acknowledgement of what they actually experienced, and fortunately they had each other to provide that needed comfort. So, if anything, that is evidence of what they'd actually been through.
And mention of the C of S is not only relevant, but necessary in light of the fact that the "church" was the driving force in trying to cover up the crimes and silencing the victims and witnesses, and thereby empowering the defendant.
What a POS an attorney has to be to make his living by working to free a serial rapist.

Did you already know or did you ask ChatGPT?

I am offended that you would ask such an impertinent question!

Of course I knew.

I happen to have extensively studied the ultra-demanding science of knowing how to knowan advanced technological discipline from which I earned innumerable degrees and their handsomely framed scientific certifications on my walls to prove it.
