Wow! After previously rejecting Scientology’s attempt to sway Danny Masterson’s appeal, this time the court has accepted the church’s 70-page ‘amicus’ brief with only three weeks to go before the oral arguments hearing.
Masterson was convicted in 2023 of two counts of forcible rape that put him in prison for 30 years to life. He’s currently housed at the Men’s Colony in San Luis Obispo County. He’s appealing that conviction with attorney Cliff Gardner, who will be speaking for the That ‘70s Show actor at the June 25 hearing in Los Angeles.
In December, the Second Appellate District rejected Scientology’s previous attempt to put its weight on the scales with an amicus brief, and without explaining why it was denying to consider a document that our expert, TX Lawyer, said could have cost Scientology leader David Miscavige up to $500,000 to assemble.
This time, however, the court, again without any explanation why, has decided to accept a new version of the amicus that was submitted to the court on May 8.
The amicus is a litany of complaints about the way Judge Charlaine Olmedo and prosecutors Reinhold Mueller and Ariel Anson spoke about Scientology at trial. That harsh language, and Olmedo’s rulings, violated First Amendment guidelines about religion in court, and infringed Masterson’s religious rights, the church argues.
We’ll be very interested to see if the three justices actually ask about this stuff during the June 25 hearing. But for now, we knew you’d want to see the entire thing.
