Was David Miscavige behind Tom Mesereau’s biggest blunder at Danny Masterson’s prelim?

[Mesereau, Miscavige, Masterson, and Podberesky]

With another set of hearings coming up for Danny Masterson in both his civil and criminal cases this Monday, we have been thinking about the dramatic four days we spent in Los Angeles at his last courtroom appearance.

We were watching as Masterson went through his preliminary hearing on rape charges that could put him in prison for 45 years to life if he’s convicted. As a result of the hearing, Judge Charlaine Olmedo found that probable cause existed and she bound him over for trial. His next arraignment will take place Monday afternoon.

In particular we’re thinking back to day two of the prelim, which took place on Wednesday, May 19. On that day, sitting next to us in the front row of the courtroom was attorney Vicki Podberesky, which we noted in our reports from the courthouse that day.~~~READ MORE

I recall hearing David Miscavige bellow (scream) in OSA Legal while I worked at OSA INT.

"THE LAWYERS ARE PAID TO DO WHAT WE *TELL* THEM TO DO ! ~~ NOT WHAT THEY WANT TO DO.

Although Miscavige is no trained lawyer he believes he can *run* them for better result

That feeling when the phone rang, it took ages to get past the fear and loathing of phone calls from management, but a lawyer getting orders from the little shrimp at the top would be so awful, mostly because she'd know he has no clue and because he would be pouring tone 40 hate down the line that is beyond my imagination.

We witnessed Miscavige's courtroom mastery in the Debbie Cook trial. He intentionally sued and dragged into open court one of the cult's most respected, knowledgeable & potentially damaging whistleblowers in the person of formerly high-ranking RTC exec and the Commanding Officer of the #1 money-maker in all of Scientology worldwide, the "Flag Land Base".

He purposely gave Cook an international venue with vast reporting resources covering her every micro-move and utterance.

Then she was put on the witness stand for what can only be described as a KSW move (Kamikaze Suicidal Witness). The cult actually tried to kill themselves! Must have been some kind of fawning homage to Ron and his customized e-meter (electrocution meter)!

She began telling in gruesome detail the "time, place, form and event" all of the cults sadistic tortures and terrorism. The cult immediately regrouped, and got her yanked off the witness stand before she could further devastate Scientology--by throwing at her some vast sums of money to stop. They paid her a fortune to stop, but the cult was the one that forced her to testify in the first place! LOL

So that's how well Miscavige's tech works.

1. Commit human rights atrocities against an innocent person
2. Long after they escape, spend millions on lawyers to sue them and drag them into open court.
3. Force them to testify when it is being broadcast out to mainstream media outlets worldwide.
4. When they start to testify, immediately pay them vast sums to stop testifying.
5. That's right, sue them for millions and resolve the the case by paying them millions.

That needed to be said, good post!

As far as your comment about "that feeling when the phone rang", you might have been afflicted by one or possibly two clinical conditions, which I believe I may have suffered from as well:

RTC Syndrome
(Religious Telephonic Call Syndrome)

PTSD
(Potential Telephonically Scientological Dread)

HOW I CURED BOTH: After a couple calls that attempted to "handle" me, I created a dedicated phone line that I never answered or listened to messages on. I think I kept that line more than 20 years before the calls stopped coming in. Then again, they could still be calling, I wouldn't know, LOL (true story!)

While listening to an account of what was happening in The Hole, I was struck by the similarity to Chinese Communist "struggle sessions", which I think provided the idea for "Gang Bang Sec Checks".

.

Excellent reference, first time I ever got a specific view of what kinds of psychological torture took place in China.

Here are excerpts from that article with some gratuitous editorial natter:

- - "The process of struggle sessions served multiple purposes. First, it demonstrated to the masses that the party was determined to subdue any opposition (generally labeled “class enemies”--i.e. "SPs", "Psychs", "Squirrels" or "Dilettante DBs with CI") , by violence if necessary."

- - "Carefully arranged and organized, the mass trials and accusatory meetings followed clear and meticulously prearranged patterns --i.e. Standard gangbang sec-checking & standard Fair Gaming. Dramatic devices such as staging, props, working scripts, agitators, and climactic moments (--and Com Evs, RPF assignments & SP declares )were used to efficiently engage the emotions of the audience—to stir up resentment against the targeted groups and mobilize the audience to support the regime.
- - "The Cultural Revolution began and I was transferred to another labor camp… Two years after I had been in this new camp, I received a parcel from my family. Immediately, an inmate accused me of giving something out of it to another prisoner. I was dragged to the office. Without any investigation, the officer assembled the entire camp to start a struggle session against me. In the session the officer suddenly asked me whether I had committed my alleged original crime leading to my 8-year sentence. I was stunned. It then dawned on me that this session was in fact prearranged. The parcel was only a pretense. Their real motive was once again to force me to admit all my alleged crimes. "I did not commit any crimes," I asserted firmly. Immediately two people jumped on me and cut off half of my hair. The officer screamed again: "are you guilty?" I replied firmly again, "no." Two people then used a rope to tie my hands back tightly. It was connected to a loop around my shoulder and underneath my armpits. It was knotted in such a way that a slight movement of my hands would cause intense pain. This struggle session lasted for two hours. Afterwards, they untied me and handcuffed me instead. The handcuffs became a part of me for the next one hundred days and nights.." (The only major difference between this and unreasonable Scientology Justice is that the Chinese version: 1) Does not as if the subject had enough sleep. 2) Does not incarcerate subjects for years like the RPF, RPF's RPF and "The Hole"--instead opting to get them thru the cycle and back onto post quickly so as not to lose production time.)
- - "You Xiaoli was standing, precariously balanced, on a stool. Her body was bent over from the waist into a right angle, and her arms, elbows stiff and straight, were behind her back, one hand grasping the other at the wrist. It was the position known as "doing the airplane." Around her neck was a heavy chain, and attached to the chain was a blackboard, a real blackboard, one that had been removed from a classroom at the university where You Xiaoli, for more than ten years, had served as a full professor. On both sides of the blackboard were chalked her name and the myriad crimes she was alleged to have committed..." (Scientology does not use blackboards, as was the case with Debbie Cook. Because writing and erasing things on a chalkboard would bring "arbitraries" into it, which is not standard. Instead, Scientology figures out the crimes beforehand and then has a professionally printed sign hung around the guilty party's neck with a singular and properly-surveyed crime (e.g. "I am a Lesbian!")

The major difference between the cult and the worst excesses of Pekin or the Kremlin is that people are not usually actually killed.

Once upon a time there was the period of cult history called 'The Battle of Britain' . Alexander J Siberskey was sent at Hubbard's orders to get the UK out of emergency. He arrived with the persona of a Nazi officer and acted like one. He was following LRH's orders and it was utterly destructive. We had staff meetings at 3.00am, if your stats were up you could sleep, otherwise you worked. There was no way to earn any money, no 'moonlighting' and no org pay. I lost weight, dangerously so. There is a big thread on the subject on the old site. This in an outer org, at saint hill he was far worse. We had meeting where he would tell people how awful the stats were and at least once offered the chance to just walk out, some did, the idiots like me stayed. There must have been a world shortage of yellow mimeo paper caused by the amount of declare orders being pumped out. It was certainly one of the heaviest moments, and not just for me, but for the whole of the cult in the UK. The UK didn't recover for a very long time.

This was a mission sent by Hubbard, something he controlled, it was long before Miss Carriage had any hand in matters. There are those that think Hubbard was soft and cuddly and that the little shrimp is the problem, no, he learned from 'the old man'. I'm sure that Hubbard would have been micro-controlling the lawyers too, maybe not directly as he needed to not be held responsible, but he would be there giving the orders.
