The Danny Masterson Trial thread

A good luck kiss? Danny Masterson shares a loving moment with wife Bijou Phillips as That '70s Show star waits for a verdict in his rape trial after jury was forced to 'start over' with their deliberations
  • Danny Masterson, 46, and his wife Bijou Phillips, 42, were spotted at the courthouse during a lunch break on Monday as they awaited a verdict
  • The former 'That ´70s Show' star has pleaded not guilty to raping three women at his Hollywood Hills home between 2001 and 2003
  • His wife, who has stood by him, was spotted kissing and hugging him Monday
  • The jurors announced Nov. 18 they were unable to reach a unanimous verdict
  • On Monday, two jurors tested positive for Covid-19 and Judge Charlaine Olmedo replaced them with alternates. She told the jury to 'start over' with deliberations
  • If jurors are still unable to reach a unanimous verdict, Judge Olmedo would have no choice but to declare a mistrial and Masterson would walk free
  • He is facing a sentence of 45 years to life in prison if he's found guilty

I don't envy Bijou. Waiting for the axe to fall and the wait is just getting longer and longer.

I think Danny will walk and this is why:

"This is significant, because Cohen and the Deputy DAs prosecuting the case know that Masterson cannot be charged with the December 2001 unconscious sodomy in this trial because, since Jane Doe 3 was unconscious for it, it doesn’t fit California’s definition of “forcible rape,” which must include overcoming a woman’s will through force or fear. And for the particular law that the DA’s office is charging Masterson under, the “One Strike” law that allows them to get around the statute of limitations, forcible rape is required"

"But Cohen is not only aware of it, he made a rather horrendous statement about it during an October 3 pretrial hearing.

"Cohen was very open about it: If Masterson had simply knocked these women out cold with alcohol or drugs, then they wouldn’t be having a trial.

“We would love this to be a rape by alcohol or drugs case because it wouldn’t be here,” he said.

As jury looks at Jane Doe 3, let’s keep in mind Cohen’s statement about unconscious rape

Unless the jury is sufficiently aware of the prosecutions "work around" they will have no ability to use the unconscious sodomy as the crime.

That is my impression of Cohen - he walked in after the 2nd quarter, when his team was already losing. He has a shitty team, but he knows how to play ball.

Even if Masterson is acquitted of the charge involving Jane Doe 3 that doesn't mean he would walk. If he's found guilty on the other two charges he's still screwed, looking at 30 years to life.

What happens if they find him guilty of just one charge? Isn't that when the 6 year statute of limitations comes in?

The way I understand it, it has to be multiple assaults to void the statute of limitations. If it is just one - he walks.

Yeah, he would walk if convicted on only one charge.

If he walks, do Scientologists start writing success stories, releasing balloons from the ceiling and repetitively screaming "THE WAR IS OVER!"?

Good points!

However, even with the civil lawsuits vs. Masterson still hanging over his head, I think it's safe to assume that if he walks on the criminal cases—there will nonetheless be a dynamic swing up the tone scale for all Scientologists on the Bridge!

Research indicates that if Masterson somehow avoids justice on the serial rapes, Scientologists will experience a dramatic spiritual resurgence of sufficient magnitude that Advance! magazine will once again begin receiving and publishing massive waves of OT parking wins.

Masterson cannot entirely avoid justice. This case has cost him millions so far, both in legal costs and getting fired from his job as an actor.

And if he IS convicted of just a single charge, even though he won't serve time in prison who in Hollywood would use him as an actor now that he is a convicted rapist?

A conviction, even if it doesn't result in time in prison will have far-reaching consequences for Masterson, and I believe for Scientology as well.

Yes, his reputation is now (and deservedly) complete dog poop.

And his bank accounts are all being drained far faster than if he was handcuffed inside a cult sales office with a dozen hardcore, hard-sell registrars.

And besides the public relations meltdown and lost of millions of dollars on legal bills and being an unemployable "celebrity", Danny has other even more stressful situations—such as whether he will still be allowed to use the Celebrity Centre's super secret actor entrance to the super VIP private actor course room.

That would be the ultimate indignity to suffer, wouldn't it? To wit, having to sit in a public course room and degrade himself by asking a non-celebrity for checkouts on his clay demos!

As bad as Masterson's situation may be I believe he can have a big win by using the successful action of O.J. Simpson. He can write a book entitled "If I did it" and probably some publishing house will write him a decent size check.
