One of the strangest criminal prosecutions we’ve ever seen, involving accusations between two of Scientology’s most wealthy donors, concluded yesterday when a trial in Lugano, Switzerland resulted in Ivan Gaspari being sentenced to 5.5 years in prison.

Public prosecutor Veronica Lipari had asked for 7 years, and on the third day of trial when it had become obvious that Judge Amos Pagnamenta was convinced of Gaspari’s guilt, Gaspari’s own attorney requested a sentence of 3.5 years.

A defense attorney suggesting a penalty before a trial had concluded was only one of the things that made this proceeding so different than the kind of jurisprudence that we’re more used to here in the U.S.

Wait. Let me make a potentially futile attempt to wrap my head around this:

One Scientology whale brings criminal charges against another whale?

What happened to Scn “justice” system? Shouldn’t the issue been quietly resolved in the org?

Scn justice in this case would be like a lawsuit case between two Sicilian mafia families. The judge would proceed to take bribes from both sides and end up not knowing what to do.


Speaking more seriously - Trish Duggan is beyond my pay grade, they would never let me handle anything like this. So can't speak from personal experience, can only make an educated guess:
Regardless if they would try to settle this quietly or not, it would for sure not be a run-of-the-mill ethics process. I would sooner imagine 20 lawyers per each side with OSA legal people in the middle trying to cobble together some agrement.

The judge can take bribes from both sides and then enter the witness protection program before the losing side comes looking for him.
