The Danny Masterson Trial thread

it seems to me he's a born-in slacker who probably isn't interested in the commitment and effort it would take to do the OT levels. i'm guessing that in a family like his, going 'clear' is probably like going through confirmation as a youth in a christian church, going through the motions whether you turn out to be dedicated to the faith or not.

i don't get the impression he ever really did much like promoting scn even before he got in trouble, and was become well known in That '70s Show when he would have been an influencer for young people. like a lot of the born in celebs i really wonder if he cares about scn at all except to keep up his relationship with his family, particularly an egotistic sociopathic type like him.
I remember seeing him and his brother at events in California. Not like I talked with him, just saw him around more prominent celebs - Cathy bell and Jenna Elfman etc. But he was the little tiny fish. Travolta, Elfman, Bell - they were the big shots.

EDIT:
I looked at Ortega's site and he has some photos and footage from the 2001 San Fran opening:

Thar she blows. Masterson with Bell and some other people. I'm pretty sure Kirstie Alley, Travolta and some other people were there too.

also, isn't there no sign his wife has gotten involved at all, which i think is another tell that it's of no real significance to him?
Bijou Philips afaik is very much a scientologist.

Yeah, I had similar thoughts, from what is known already he obviously was never a dedicated Scientologist, guilty or not. It was probably a little of both, the church doesn't want him/won't allow him to do the OT levels and he also doesn't want to do them because he'd have to stop partying.

I told her about other times. I don't remember specifically said that time. But I told her about there being other times.

You told her generally about these incidents?

Yes sir. When I told her what happened, she stopped me and she told me not use the word 'rape.' She explained you cannot rape someone you're in a relationship with.

How did you feel about that?

I believed her.

Why did you believe her?

She was the ethics officer. I trusted her.

:dizzy:

You'd be surprised how often people had some sort of disagreement in their opinions and would ask for the ethics officer to resolve it.

thanks for that historic visual.

was that at Elfman's short lived mission that opened in September of that year? (and that she was allowed to offload before long, as it failed)

she's an example i was actually just thinking of, of a born minor celeb in who's dedicated enough to have gone out and promoted scn including on the talk show circuit, not to mention putting some time and money into dissemination like that.

he on the other hand seems to have just showed up at things like that you'd expect to see him at regardless, but not much if anything more.

As much as I hope Scientology will make some changes from the flack they get from this rape case, I doubt it will move the ta at all.

Mimsey
I think if they will make changes, it will be in the archives. As in the people at ADU will be ordered to go through the files and destroy stuff related to possible high black PR things. I'm pretty sure Miscavige will be furious that the KR is used as evidence in this case and he will not want to risk the same stuff being repeated in any future lawsuits.

Pretty much my impression.

Ahh the early 2000s when we were young, hot and stupid. Nowadays, I'm just stupid.

Good Report......

A couple of good Court Room observations.

There is an interesting discusion at the end of the video about Danny Masterson taking the Stand... will he or won't he...?

I was in there pretty much in there every day for months, even after we had broken up. Because after my program, when I was doing my Conditions, I asked him if he was going to go to ethics and handle it. And I had told myself based on his answer would be my decision and I would come up out of Conditions. Hard to explain.

What was his answer?

I was standing in the living room and he was a step up in the hallway, the entrance way. I asked him if he was going to go to ethics and handle it. He said no, he didn't have to because he was prospering in life.

You understood what that meant? What did it mean to you?

I read something called "Ethics Protection."

What did that mean?

When someone's statistics are up in life, they're called "upstats."

Based on his response, how did you feel about the relationship?

I was done. I was at the part of Conditions when you are trying to figure out which group, I can't remember what it said exactly, but you have to make a decision about relationships, and I told him I was done.

How did he react?

He did not want that to happen.

JANE DOE 3 PANIC ATTACK: Danny Masterson Trial, Day 10, lunch break report

My question - it looks like the trial is looking dismal for Danny - can he plea bargain for a lesser charge and do less time?

If so, I would think Miscavage would pressure him to do so to stop the out PR bleed-out.

I think it is too late for Davey to do that. MAYBE his attorney will convince Danny that a plea bargain is his last shot.

Side note:
Even should the rape allegations turn out to be false - it is obvious by now that Masterson was a slacker, did drugs, abused alcohol, is not really attractive, is quite lewd, rude, disrespectful towards women and is part of a cult on top of it all.

So I struggle to understand why otherwise successful and attractive women like Jane Doe 3 and Bijou Philips would even date this guy to begin with.

Don't get me wrong - I'm not trying to blame the victims here. Just struggling to understand what sort of positive traits Masterson may have had to make these otherwise non-desperate women fall for him.

I wouldn't be surprised this is the outcome - they opt for a plea bargain - which has its own perils - see last quote

Prohibitions On Plea Bargaining

There are certain felony cases where California law prohibits the state from plea bargaining. These include:

  • Serious felonies
  • Violent sex crimes
************************
Why a Plea Bargain May Be a Good Option in Some Sex Crime Cases
Being charged with a sex crime is just the first of many steps involved in the prosecution of a criminal offense. If an agreement is not reached prior to trial, the defendant has a constitutional right to a jury trial and to be represented by counsel at that trial. If a defendant is found not guilty by the jury, a judgment of acquittal is entered by the trial court, and the case is dismissed. Because of the double jeopardy clause, a defendant who has been acquitted cannot be retried in most cases (although there are a few exceptions). For someone who maintains that he or she is innocent, an acquittal may seem like the ideal outcome of the case.

Unfortunately, juries do not always see things in the same way that the defendant does. Many sex crime cases hinge on the testimony of the alleged victim. The defendant has a right to remain silent and to refrain from self-incrimination, so he or she often does not testify at trial. If the jury believes the victim's version of the events, even after vigorous cross-examination by the defendant's lawyer, it is possible that a guilty verdict may be entered. Physical evidence also can be subject to multiple interpretations and used by the State to suggest that what the defendant insists was a consensual act was, in fact, against the victim's will.

When a defendant is convicted as charged of rape, sexual assault, lewd conduct, or another sex offense, the judge must follow the state's sentencing laws for that crime. The advantage of a plea bargain is that the defendant may be able to plead guilty to a lesser crime - that is, a crime with a less severe sentence that involves less jail time or even just probation. The State may agree to this if there are possible weaknesses in the case against the defendant. For example, there could be an issue regarding the admissibility of certain evidence, or the victim's credibility may be questionable.

*********************
Defending a Rape Charge
Defending a sex crime charge may be challenging. This is true in traditional rape cases as well as in a “date rape” situation, in which the defendant and the alleged victim are acquainted with each other. The parties may agree that intercourse or another sexual act took place but disagree as to whether effective consent was articulated. Since lack of consent is one of the key elements of the crime of rape, the burden of proof is on the State of California to prove the absence of consent beyond a reasonable doubt. Typically, this is done through the testimony of the alleged victim. Although the defendant has a right to testify on their own behalf, many defendants exercise their Fifth Amendment right to remain silent and refrain from giving the prosecution an opportunity to cross-examine them or undermine their credibility.

It should also be noted that consent is not always an effective defense in a rape or date rape case. Victims who are below a certain age or who lack mental capacity are not able to legally “consent,” even if they do verbally agree to have intercourse with the defendant. Consent is also unlikely to be an effective defense in cases in which the alleged victim was asleep, unconscious, or severely intoxicated. However, the situation is often not straightforward. A knowledgeable rape defense attorney can assist Riverside County and San Bernardino residents with determining which defenses may apply to their circumstances.

Penalties for the Crimes of Rape and Date Rape in California
The crimes of rape and date rape are felonies in California. The punishment faced by a particular defendant depends on several factors, including the age of the alleged victim. Typically, the punishment for rape is between six and eight years of imprisonment in the state penitentiary. However, if the person against whom the crime was perpetrated was a minor, the defendant may face up to 13 years in prison. Fines and other penalties, such as inclusion on the sex offender registry, may also be imposed.

"Any felony offense has the potential to affect the defendant’s life and livelihood for many years to come. Especially with regard to registered sex offenders, finding work and suitable living accommodations may be very difficult, and the offender risks additional penalties if they do not comply with the requirements of the registry."

If Danny becomes a registered sex criminal - his hollywood career is over.

Maybe you don't see him as attractive, these women did. See these interviews - he doesn't come across a bad person

Ok, I found a puzzling item in this case transcript by Tony Ortega. it is something Jane Doe said about he misadventures with ethics after Danny 'allegedly' raped her.

Fair use quote, section underlined by me:

"JD3: I was going to write a Knowlege Report...
M: What is that?
JD3: It's a report where you write up any out-ethics behavior. And then it goes into your ethics folder. But Miranda didn't let me do that, she said I had to write a Things That Shouldn't Be report.
M: What's the difference.
JD3: I"m not sure but I know that the Things That Shouldn't Be report would go into his "pre-clear" folder. I asked why. And she said because they'll handle it in session. But he didn't go into session, and I didn't understand why he didn't go into ethics.

And the question is: Why a TTSNB and not a KR?

This really got me thinking, because the answer does not appear obvious at least to me and I've been an EO and an MAA and at inv for quite a bit.

In other circumstances asking for a TTSNB instead of a KR it could be to shield the person making the report from the wrath of the one being reported. Or not to "tip the accountable unit off" while the investigation continues, data is still gathered etc. But that doesn't seem to have been the case here, as Jane Doe already told Danny she's gonna report him.

So what is my best guess? It is just speculation, but I feel they didn't want Danny to have a copy, so that he would not be able to take that document and use it in court/police in case he would leave the church (or be thrown out of the church).

Anyone else has any good ideas?

Maybe it was because of what he was wearing.
